| I will soon be introducing legislation that would provide for the regulation of establishments that perform body art services, specifically, body piercing, tattooing and permanent cosmetics. Many individuals incorrectly assume that because these establishments utilize needles that they are licensed; however, there are currently no licensing requirements for tattoo establishments or body art practitioners in Pennsylvania. There is a real concern that these procedures may be occurring in less than sterile environments. Further, due to the many health and safety issues surrounding the use of tattoo needles and the various safety risks associated with contaminated bodily fluids it is necessary for minimum standards of practice to be established in order to safeguard consumers' health and safety during these invasive procedures. My legislation, known as The Body Art Establishment Regulation Act, would require a $100 licensing fee per establishment. The Department of Health would conduct an initial inspection, upon receipt of an application and then require the Department to randomly inspect establishments annually. Further, the bill provides that the Department shall set health and safety standards to ensure body art procedures are performed in sterile environments and by qualified professionals. This legislation will allow the Department of Health the opportunity to protect the well-being of anyone undergoing such procedures by ensuring that the equipment used is sterile and the facilities meet the Department's standards. |
