Brief Description The amendment changes the definition of surprise balance billing to assure the Act only applies in situations where the patient did not chose to have the services provided by an out-of-network provider. Additionally, it adds a definition for usual, customary and reasonable rate. The payment structure for disputed claims is also changed so that claims of $500 or less will be paid the higher of the usual, customary and reasonable rate or the insurers in-network rate for the same service. For claims which are over $500, arbitration will still apply. It also makes further technical amendments.
