Brief Description |
Inserts definitions for “interrogation”, “malfeasance”, “misfeasance, and “nonfeasance”; allows for DOC to conduct interrogations of correctional officers on approved leave; requires all parties of an interrogation to make known their name and professional title; allows the DOC to initiate an immediate interrogation without 24 hours’ notice in serious situations; in accordance with the federal Prison Rape Elimination Act, allows the identity of a complainant to remain anonymous following an allegation of sexual abuse or harassment; requires that an allegation of misfeasance be classified as unfounded and expunged from the CO’s record if no evidence is obtained within 60 days; requires that an allegation of misfeasance be classified as unfounded and expunged from the CO’s record if more than 60 days have transpired since the alleged date of the act; allows for personal financial information of the CO to be obtained lawfully if the nature of the investigation necessitates the disclosure of such information; includes various technical edits, insertions, and deletions.
