A RESOLUTION
Directing the Joint State Government Commission to conduct a
study to analyze and identify which transportation laws and
regulations of this Commonwealth have more stringent
standards than Federal law requires.
WHEREAS, Executive Order 1996-1, issued by the Governor on
February 6, 1996, provides that State agency regulations may not
"exceed federal standards unless justified by a compelling and
articulable Pennsylvania interest or required by state law"; and
WHEREAS, Because of the complexity and close interworking of
Federal and State transportation law, it is important that the
relationship between Federal and State transportation law and
regulation be examined and understood; therefore be it
RESOLVED, That the Senate direct the Joint State Government
Commission to conduct a study to analyze and identify which
transportation laws and regulations of this Commonwealth have
more stringent standards than Federal law requires; and be it
further
RESOLVED, That the Joint State Government Commission report
its findings and recommendations to the General Assembly within

one year of the adoption of this resolution.
