AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in safe schools, establishing the
School Student Mental Health Assistance Augmentation Account
and providing for deposit of court costs and filing fees into
the account; and making an inconsistent repeal.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 1302.2-A. School Student Mental Health Assistance
Augmentation Account.--(a) The School Student Mental Health
Assistance Augmentation Account is established within the
General Fund as a restricted receipt account.
(b) Notwithstanding 42 Pa.C.S. § 3733(a.1)(2)(iii) (relating
to deposits into account), for the fiscal year 2018-2019 and
each fiscal year thereafter, eight dollars ($8) of each

additional fee imposed under 42 Pa.C.S. § 3733(a.1)(1) shall be
deposited into the account, and two dollars ($2) of each
additional fee shall be deposited into the Access to Justice
Account.
(c) Money deposited into the account is appropriated on a
continuing basis to the Department of Education for distribution
under subsection (d).
(d) All money deposited into the account shall be used for
the purpose of providing grants to school entities to hire and
retain mental health professionals. The Department of Education
shall, upon written application and subsequent approval, grant
money from the account to a school entity. A school entity shall
use the grant award to hire and retain one of the following
mental health professionals:
(1) A certified guidance counselor.
(2) A school psychologist.
(3) A licensed social worker.
(4) A licensed clinical social worker.
(5) A licensed professional counselor.
(6) A marriage and family therapist.
(e) The Department of Education shall establish grant
application review procedures and priorities in grant funding.
(f) Grant money allocated through the account shall be used
to supplement and not supplant existing school entity spending
on mental health professionals.
(g) As used in this section, "account" shall mean the School
Student Mental Health Assistance Augmentation Account.
Section 2. The provisions of 42 Pa.C.S. § 3733(a.1)(2)(iii)
are repealed insofar as they are inconsistent with the addition
of section 1302.2-A of the act.

Section 3. This act shall take effect August 1, 2018, or
immediately, whichever is later.
