AN ACT
Amending Title 18 (Crimes and Offenses) of the Pennsylvania
Consolidated Statutes, in dissemination of criminal history
record information, further providing for expungement.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 9122(b) of Title 18 of the Pennsylvania
Consolidated Statutes is amended by adding a paragraph to read:
ยง 9122. Expungement.

(b) Generally.--Criminal history record information may be
expunged when:

(4) (i) An individual who is the subject of the
information was convicted of an offense occurring prior
to February 15, 2018, under section 13(a)(16) of the act
of April 14, 1972 (P.L.233, No.64), known as The
Controlled Substance, Drug, Device and Cosmetic Act, who
was diagnosed with a serious medical condition, as
defined in section 103 of the act of April 17, 2016

(P.L.84, No.16), known as the Medical Marijuana Act,
prior to the date of the offense, whose serious medical
condition existed on the date of the offense and who
possessed the marijuana that was the subject of the
offense solely for the purpose of treating the
individual's medical condition under section 403 of the
Medical Marijuana Act.
(ii) Expungement under this paragraph shall only be
permitted for information relating to the conviction
under section 13(a)(16) of The Controlled Substance,
Drug, Device and Cosmetic Act.

Section 2. This act shall take effect in 60 days.
