AN ACT
Amending the act of October 20, 1966 (3rd Sp.Sess., P.L.96,
No.6), entitled "An act relating to mental health and
intellectual disability; authorizing county programs and
amending, revising and changing the laws relating thereto and
making an appropriation," in general provisions relating to
facilities, admissions and commitments, providing for
community homes for individuals with an intellectual
disability.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of October 20, 1966 (3rd Sp.Sess.,
P.L.96, No.6), known as the Mental Health and Intellectual
Disability Act of 1966, is amended by adding a section to read:
Section 427. Community Homes for Individuals with an
Intellectual Disability.--(a) A caseworker shall provide an
applicant who qualifies for residential services, or an
individual designated on behalf of the applicant, with a list of
community homes for individuals with an intellectual disability
prior to committing to admission at a community home.
(b) Using existing resources, the department shall publish a
complete list of community homes for individuals with an

intellectual disability in this Commonwealth on the department's
publicly accessible Internet website.
(c) As used in this section, the term "community homes for
individuals with an intellectual disability" shall mean a
building or separate dwelling unit in which residential care is
provided to one or more individuals with an intellectual
disability. For purposes of this section, an apartment unit
within an apartment building is considered a separate home and
each part of a duplex, if there is physical separation between
the living areas, is considered a separate home.
Section 2. This act shall take effect in 60 days.
