AN ACT
Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
act to consolidate, editorially revise, and codify the public
welfare laws of the Commonwealth," in public assistance,
providing for replacement of electronic benefits card.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of June 13, 1967 (P.L.31, No.21), known
as the Human Services Code, is amended by adding a section to
read:
Section 438. Replacement of Electronic Benefits Card.--(a)
An individual receiving public assistance benefits on an
electronic benefits card issued by the department shall be
subject to the following card replacement fee and penalty
schedule if the individual's electronic benefits card is lost or
stolen:
(1) For the first request, the recipient shall be subject to
a replacement fee established by the department which shall be
calculated to ensure that there is a cost-neutral impact on the

department for printing the replacement card with the photograph
of the recipient.
(2) For a second request within a twelve-month period, the
fee established under paragraph (1) shall be doubled.
(3) For a third request within a twelve-month period, the
benefits provided to the recipient shall immediately be revoked
and the recipient shall be subject to a lifetime ban from
receiving public assistance.
(b) This section shall not apply to:
(1) Funds deposited onto an individual's electronic benefits
card which relate to child or State blind pension funds.
(2) Replacement of an electronic benefits card that is
damaged or defective if the recipient returns the card to the
county assistance office.
Section 2. This act shall take effect in 60 days.
