AN ACT
Amending the act of May 17, 1921 (P.L.682, No.284), entitled "An
act relating to insurance; amending, revising, and
consolidating the law providing for the incorporation of
insurance companies, and the regulation, supervision, and
protection of home and foreign insurance companies, Lloyds
associations, reciprocal and inter-insurance exchanges, and
fire insurance rating bureaus, and the regulation and
supervision of insurance carried by such companies,
associations, and exchanges, including insurance carried by
the State Workmen's Insurance Fund; providing penalties; and
repealing existing laws," in comprehensive health care for
uninsured children, further providing for CHILDREN'S HEALTH
CARE AND FOR expiration.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 2309-A of the act of May 17, 1921
(P.L.682, No.284), known as The Insurance Company Law of 1921,
added December 20, 2015 (P.L.461, No.84), is amended to read:

IS AMENDED BY ADDING A SUBSECTION TO READ:
SECTION 2302-A. CHILDREN'S HEALTH CARE.

(G) LIMITATION OF COVERAGE.--THE BENEFIT PACKAGE FOR
ELIGIBLE CHILDREN MAY NOT INCLUDE REIMBURSEMENT FOR GENDER OR
SEX REASSIGNMENT SURGERY OR GENDER OR SEX TRANSITION SERVICES,
INCLUDING, BUT NOT LIMITED TO, PHYSICIAN'S SERVICES, INPATIENT
AND OUTPATIENT HOSPITAL SERVICES, PRESCRIBED DRUGS OR COUNSELING
SERVICES RELATED TO SUCH SURGERY OR SERVICES.
SECTION 2. SECTION 2309-A OF THE ACT, ADDED DECEMBER 20,
2015 (P.L.461, NO.84), IS AMENDED TO READ:
Section 2309-A. Expiration.
(a) General rule.--[This] Subject to subsection (a.1), this
article shall expire on the earlier of:
(1) December 31, [2017] 2019; or
(2) ninety days after the date on which Federal funding
for the program ceases to be available.
(a.1) Exception.--If Federal law authorizes funding for the
program for a period that extends beyond December 31, 2019, this
article shall expire under subsection (a)(2).
(b) Notice.--If [the chapter] this article expires under
subsection (a)(2), as determined by the department, the
department shall transmit notice to the Legislative Reference
Bureau for publication in the Pennsylvania Bulletin.
Section 2 3. This act shall take effect immediately.
