A RESOLUTION
Directing the Joint State Government Commission to conduct a
study to analyze and identify which environmental laws and
regulations of this Commonwealth have more stringent
standards than Federal law requires.
WHEREAS, Executive Order 1996-1, issued by the Governor on
February 6, 1996, provides that State agencies may not exceed
Federal standards unless justified by a "compelling and
articulable" interest or required by State law; and
WHEREAS, Section 6.6 of the Air Pollution Control Act
provides that the Environmental Quality Board may only establish
certain more stringent air quality standards when needed to
protect public health, welfare and the environment; and
WHEREAS, Because of the complexity and close interworking of
Federal and State environmental law, it is important that the
relationship between Federal and State environmental law and
regulation be examined and understood; therefore be it
RESOLVED, That the Joint State Government Commission conduct
a study to analyze and identify which environmental laws and

regulations of this Commonwealth have more stringent standards
than Federal law requires; and be it further
RESOLVED, That the commission report its findings and
recommendations to the General Assembly within one year 18
MONTHS of the adoption of this resolution.
