4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Title 18 of the Pennsylvania Consolidated
7Statutes is amended by adding a section to read:

8§ 5518. Use of laser pointer.

9(a) Offense defined.--A person commits an offense if that
10person knowingly, with the intent to harass, annoy or alarm,
11shines a laser pointer at another person.

12(b) Grading.--

13(1) Except as provided in paragraph (2), an offense
14under subsection (a) is a summary offense.

15(2) If the offense in subsection (a) is committed
16against a person operating a motor vehicle, the offense shall
17be a misdemeanor of the third degree.

18(c) Definition.--As used in this section, the term "laser
 

1pointer" means a handheld device that emits a laser beam.

2Section 2. This act shall take effect in 60 days.
