AN ACT

 

1Requiring public schools to develop policies to ensure the
2proper application of the Commonwealth's veterans' preference
3law when making hiring decisions; and imposing duties on the
4Department of Education.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Short title.

8This act shall be known as the Proper Application of
9Veterans' Preference in Public Schools Act.

10Section 2. Definitions.

11The following words and phrases when used in this act shall
12have the meanings given to them in this section unless the
13context clearly indicates otherwise:

14"Department." The Department of Education of the
15Commonwealth.

16"Public school." A charter school, cyber charter school,
17intermediate unit, school district and area vocational-technical
18school.

1Section 3. Veterans' preference policy required.

2(a) Duty to develop.--A public school shall develop a policy
3to ensure the proper application of the provisions of 51 Pa.C.S.
4Ch. 71 (relating to veterans' preference) and relevant court
5decisions.

6(b) Publication.--A copy of the policy shall be posted on
7the public school's publicly accessible Internet website no
8later than 180 days from the effective date of this section.

9Section 4. Notification of applicants.

10A public school shall provide a copy of the policy developed
11in section 3 to all individuals who apply for employment.

12Section 5. Duties of department.

13(a) Model policy.--The department, in consultation with the
14Department of Military and Veterans Affairs, shall develop a
15model policy to ensure the proper application of the provisions
16of 51 Pa.C.S. Ch. 71 (relating to veterans' preference) in
17public schools. The model policy shall be made available to
18public schools no later than 90 days from the effective date of
19this section.

20(b) Use by public schools.--A public school may utilize and
21post the model policy on its publicly accessible Internet
22website to meet the requirements of this act.

23Section 6. Effective date.

24This act shall take effect immediately.
