AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, in registration of vehicles, providing for 
<-3Pennsylvania hunting heritage plates and for special plates
4for recipients of Combat Infantry Badge<-.; further providing 
5for special plates for individuals in the service of the 
6United States Merchant Marine; and, in fees, further 
7providing for payments to special funds.

8The General Assembly of the Commonwealth of Pennsylvania
9hereby enacts as follows:

10Section 1. Title 75 of the Pennsylvania Consolidated
11Statutes is amended by adding a section to read:

<-12§ 1355.1. Pennsylvania hunting heritage plate.

13The department, in consultation with the Pennsylvania Game
14Commission, shall design a hunting heritage plate. Upon
15application of any person, accompanied by a fee of $35 which
16shall be in addition to the annual registration fee, the
17department shall issue the plate for a passenger car, motor
18home, trailer or truck with a registered gross weight of not
19more than 14,000 pounds. Fifteen dollars of the fee shall be

1deposited into the Pennsylvania Hunting Heritage Fund and
2expended as provided in section 1905(d) (relating to payments to
3special funds).

4Section 2. Section 1357.1 of Title 75 is amended to read:

5§ 1357.1. Special plates for individuals in the service of the
6United States Merchant Marine.

7Upon application of any person who was in the service of the
8United States Merchant Marine during World War II, the Korean 
9War, the Vietnam Conflict or any of the Gulf Wars, including 
10Operation Desert Storm, Operation Iraqi Freedom and Operation 
11Desert Shield, accompanied by a fee of $20 which shall be in
12addition to the annual registration fee and by such
13documentation as the department shall require, the department
14shall issue to the person a special registration plate
15designating the vehicle so licensed as belonging to a person who
16was in the service of the United States Merchant Marine during
17World War II, the Korean War, the Vietnam Conflict or any of the 
18Gulf Wars, including Operation Desert Storm, Operation Iraqi 
19Freedom and Operation Desert Shield. The special registration
20plate may be used only on a passenger car or truck with a
21registered gross weight of not more than 14,000 pounds.

22Section 3. Title 75 is amended by adding a section to read:

23§ 1369.1. Special plates for recipients of Combat Infantry
24Badge.

25Upon application of any person who is a recipient of the
26Combat Infantry Badge, accompanied by a fee of <-$10 $20 which
27shall be in addition to the annual registration fee and by such
28documentation as the department shall require, the department
29shall issue to the person a special registration plate
30designating the vehicle so licensed as belonging to a person who

1is a recipient of the Combat Infantry Badge. The special
2registration plate may be used only on a passenger car or truck
3with a registered gross weight of not more than 14,000 pounds.

<-4Section 4. Section 1905 of Title 75 is amended by adding a
5subsection to read:

6§ 1905. Payments to special funds.

8(d) Pennsylvania Hunting Heritage Fund.--Fifteen dollars of 
9each fee received under section 1355.1 (relating to Pennsylvania 
10hunting heritage plate) shall be credited to the Pennsylvania 
11Hunting Heritage Fund, established as follows:

12(1) There is hereby established a special account in the
13State Treasury which shall be known as the Pennsylvania
14Hunting Heritage Fund. The purpose of the Pennsylvania
15Hunting Heritage Fund is to provide funding to nonprofit
16organizations as defined under section 501(c)(3) of the
17Internal Revenue Code of 1986 (Public Law 99-514, 26 U.S.C. §
18501(c)(3)) that coordinate the processing and distribution of
19donated wild game from hunters and municipal herd reduction
20sources to Pennsylvania residents through a distribution
21network of food banks in this Commonwealth, provided that 50%
22of the money in the special account shall be allocated to
23nonprofit organizations established, prior to January 1,
242014, to conserve all birds and mammals of this Commonwealth
25and the ecosystems in which they live.

26(2) All moneys in the Pennsylvania Hunting Heritage Fund
27are hereby annually appropriated to the Pennsylvania Game
28Commission and may be expended for the purposes authorized
29under this subsection.

30(3) Estimates of amounts to be expended under this

1subsection shall be submitted to the Governor by the
2Pennsylvania Game Commission for his approval.

3(4) The State Treasurer shall not honor any requisition
4for expenditures by the Pennsylvania Game Commission in
5excess of estimates approved by the Governor or in excess of
6the amount available for the purposes for which the
7requisition was made, whichever is the lesser amount.

8Section 2 5. This act shall take effect in <-60 120 days.
