AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, further providing for DARE plate and for payments
3to special funds.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 1358 of Title 75 of the Pennsylvania
7Consolidated Statutes is repealed:

8[§ 1358. DARE plate.

9The department, in consultation with the Pennsylvania
10Commission on Crime and Delinquency, shall design a special drug
11abuse resistance education (DARE) registration plate which
12utilizes the DARE logo or slogan in the design. Upon application
13of any person, accompanied by a fee of $35 which shall be in
14addition to the annual registration fee, the department shall
15issue the plate for a passenger car, motor home, trailer or
16truck with a registered gross weight of not more than 10,000

1pounds. The Drug Abuse Resistance Education Program shall
2receive $15 of each additional fee for this plate.]

3Section 2. Section 1905(c) of Title 75 is amended to read:

4§ 1905. Payments to special funds.

6(c) Drug Abuse Resistance Education Fund.--[Fifteen dollars
7of each fee received under section 1358 (relating to DARE plate)
8shall be credited to the Drug Abuse Resistance Education Fund,
9established as follows:

10(1) There is hereby established a special account in the
11State Treasury which shall be known as the Drug Abuse
12Resistance Education (DARE) Fund. The purpose of the DARE
13Fund is to provide moneys for an ongoing educational program
14in public schools to prevent drug abuse, utilizing police
15agency representatives, school district employees, materials,
16supplies and other necessary expenses associated with the
17program.

18(2) All moneys in the DARE Fund are hereby annually
19appropriated to the Pennsylvania Commission on Crime and
20Delinquency and may be expended for the purposes authorized
21under this subsection.] The following shall apply:

22(1) The Drug Abuse Resistance Education (DARE) Fund
23shall terminate at the end of the 2013-2014 fiscal year.

24(2) All money in the Drug Abuse Resistance Education 
25(DARE) Fund on the effective date of this paragraph shall be 
26appropriated to the Pennsylvania Commission on Crime and 
27Delinquency and shall be expended to provide grants to 
<-28organizations and nonprofit entities employing a 
29multidisciplinary approach to the prevention, identification, 
30investigation, prosecution and treatment of child abuse, 

1including Children's Advocacy Centers <-children's advocacy 
2centers, as defined in 23 Pa.C.S. § 6303(a) (relating to 
3definitions), during fiscal year 2013-2014. All money in the 
4the Drug Abuse Resistance Education (DARE) Fund on the date 
5of termination shall be transferred to the General Fund.

6(3) Estimates of amounts to be expended under this
7subsection shall be submitted to the Governor by the
8Pennsylvania Commission on Crime and Delinquency for his
9approval.

10(4) The State Treasurer shall not honor any requisition
11for expenditures by the Pennsylvania Commission on Crime and
12Delinquency in excess of estimates approved by the Governor
13or in excess of the amount available for the purposes for
14which the requisition was made, whichever is the lesser
15amount.

16Section 3. This act shall take effect in 60 days.
