AN ACT

Amending Title 42 (Judiciary and Judicial Procedure) of the

2

Pennsylvania Consolidated Statutes, further providing for

3

nonmedical good Samaritan civil immunity.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 8332(b)(2) of Title 42 of the

7

Pennsylvania Consolidated Statutes is amended to read:

§ 8332.  Nonmedical good Samaritan civil immunity.

(b)  Exceptions.--

11

(2)  In order for any person to receive the benefit of

13

the exemption from civil liability provided for in subsection

14

(a), he shall [be], at the time of rendering the emergency

15

care, first aid or rescue or moving the person receiving

16

emergency care, first aid or rescue to a hospital or other

17

place of medical care, meet one of the following:

(i)  Be the holder of a current certificate

evidencing the successful completion of a course in first

2

aid, advanced life saving or basic life support sponsored

3

by the American National Red Cross or the American Heart

4

Association or an equivalent course of instruction

5

approved by the Department of Health in consultation with

6

a technical committee of the Pennsylvania Emergency

7

Health Services Council and must be performing techniques

8

and employing procedures consistent with the nature and

9

level of the training for which the certificate has been

10

issued.

11

(ii)  Possess a reasonable belief that the

12

circumstances would result in the death or serious bodily

13

injury of the victim if no action is taken.

14

Section 2.  This act shall take effect in 60 days.
