| AN ACT |
| |
1 | Amending Title 18 (Crimes and Offenses) of the Pennsylvania |
2 | Consolidated Statutes, further providing for the offense of |
3 | carrying a false identification card. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 6310.3 of Title 18 of the Pennsylvania |
7 | Consolidated Statutes is amended by adding a subsection to read: |
8 | § 6310.3. Carrying a false identification card. |

10 | (f) Confiscation.-- |
11 | (1) Any person who meets all of the following may | <-- |
12 | employee, servant or agent of a person authorized to sell | <-- |
13 | liquor or malt or brewed beverages under the act of April 12, |
14 | 1951 (P.L.90, No.21), known as the Liquor Code, may |
15 | confiscate an identification card that has been presented for |
16 | the purposes of obtaining liquor or malt or brewed beverages |
17 | when there is a reasonable suspicion that a person has |

1 | presented an identification card as described in subsection |
2 | (a): | <-- |
3 | (i) is authorized to sell liquor or malt or brewed |
4 | beverages under the act of April 12, 1951 (P.L.90, |
5 | No.21), known as the Liquor Code; and |
6 | (ii) verifies the ages of purchasers of liquor or |
7 | malt or brewed beverages by placing identification cards |
8 | through an electronic scanner. |
9 | (a). An employee, servant or agent may confiscate an | <-- |
10 | identification card upon reasonable suspicion that the age or |
11 | date of birth is false only after placing the identification |
12 | card through an electronic scanner. |
13 | (2) The identification card confiscated under this |
14 | subsection shall be submitted to law enforcement personnel | <-- |
15 | the law enforcement agency having jurisdiction over the | <-- |
16 | municipality in which the licensee's place of business is |
17 | located within 48 hours after confiscation to make a | <-- |
18 | determination of the validity of the identification card |
19 | presented. The law enforcement agency shall return any | <-- |
20 | confiscated identification card that is determined to be |
21 | valid to the individual from whom it was confiscated. |
22 | Section 2. This act shall take effect in 60 days. |
