| AN ACT |
| |
1 | Amending Title 18 (Crimes and Offenses) of the Pennsylvania |
2 | Consolidated Statutes, further providing for the offense of |
3 | carrying a false identification card. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 6310.3 of Title 18 of the Pennsylvania |
7 | Consolidated Statutes is amended by adding a subsection to read: |
8 | § 6310.3. Carrying a false identification card. |

10 | (f) Confiscation.-- |
11 | (1) Any person who meets all of the following may |
12 | confiscate an identification card that has been presented for |
13 | the purposes of obtaining liquor or malt or brewed beverages |
14 | when there is a reasonable suspicion that a person has |
15 | presented an identification card as described in subsection |
16 | (a): |
17 | (i) is authorized to sell liquor or malt or brewed |
18 | beverages under the act of April 12, 1951 (P.L.90, |

1 | No.21), known as the Liquor Code; and |
2 | (ii) verifies the ages of purchasers of liquor or |
3 | malt or brewed beverages by placing identification cards |
4 | through an electronic scanner. |
5 | (2) The identification card confiscated under this |
6 | subsection shall be submitted to law enforcement personnel |
7 | within 48 hours to make a determination of the validity of |
8 | the identification card presented. |
9 | Section 2. This act shall take effect in 60 days. |
