| AN ACT |
| |
1 | Prohibiting the Commonwealth from planning, establishing or |
2 | participating in a State health care exchange. |
3 | The General Assembly of the Commonwealth of Pennsylvania |
4 | hereby enacts as follows: |
5 | Section 1. Prohibition on State-based health exchange. |
6 | (a) General rule.--No State agency, department or political |
7 | subdivision may plan, establish, participate in or enable a |
8 | State-based exchange for health insurance under the Patient |
9 | Protection and Affordable Care Act (Public Law 111-148, 124 |
10 | Stat. 119) or contract with any private entity to do so. |
11 | (b) Interaction with Federal Government.--A State agency or |
12 | department may interact with the Federal Government with respect |
13 | to the establishment of a federally facilitated exchange for |
14 | this Commonwealth. |
15 | (c) Operation of specific functions.--A State agency or |
16 | department may operate specific functions of a federally |
17 | facilitated exchange consistent with this section to enable the |

1 | continuation of traditional areas of State regulation and |
2 | authority. |
3 | Section 2. Effective date. |
4 | This act shall take effect in 60 days. |
