AN ACT

Prohibiting the Commonwealth from planning, establishing or

participating in a State health care exchange.

The General Assembly of the Commonwealth of Pennsylvania

hereby enacts as follows:

Section 1.  Prohibition on State-based health exchange.

(a)  General rule.--No State agency, department or political

subdivision may plan, establish, participate in or enable a

State-based exchange for health insurance under the Patient

Protection and Affordable Care Act (Public Law 111-148, 124

Stat. 119) or contract with any private entity to do so.

(b)  Interaction with Federal Government.--A State agency or

department may interact with the Federal Government with respect

to the establishment of a federally facilitated exchange for

this Commonwealth.

(c)  Operation of specific functions.--A State agency or

department may operate specific functions of a federally

facilitated exchange consistent with this section to enable the

continuation of traditional areas of State regulation and

authority.

Section 2.  Effective date.

This act shall take effect in 60 days.
