| AN ACT |
| |
1 | Amending Title 23 (Domestic Relations) of the Pennsylvania |
2 | Consolidated Statutes, extending the right of child support |
3 | to estate of decedent. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 3707 of Title 23 of the Pennsylvania |
7 | Consolidated Statutes is amended to read: |
8 | § 3707. Effect of death of either party. |
9 | (a) Alimony.--Upon the death of the payee party, the right |
10 | to receive alimony pursuant to this chapter shall cease. Upon |
11 | the death of the payor party, the obligation to pay alimony |
12 | shall cease unless otherwise indicated in an agreement between |
13 | the parties or an order of court. |
14 | (b) Child support.--Upon the death of a parent of a minor |
15 | and unemancipated child, the obligation of an estate to pay |
16 | child support shall continue. The court shall order an amount |
17 | set aside in reasonable proportion to the extent necessary for |
18 | support of the minor and unemancipated child in accordance with |
19 | the amount available from the assets of the estate. |
