| AN ACT |
| |
1 | Amending Title 75 (Vehicles) of the Pennsylvania Consolidated |
2 | Statutes, further providing for issuance and content of |
3 | driver's license; and providing for emergency contact |
4 | database. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Section 1510(d) of Title 75 of the Pennsylvania |
8 | Consolidated Statutes is amended to read: |
9 | § 1510. Issuance and content of driver's license. |

11 | (d) Medical history record.--Any person may attach to the |
12 | reverse side of his driver's license or identification card |
13 | information relating to his personal medical history. In |
14 | addition, any person may add medical information to the person's |
15 | driving record via the department's emergency contact database |
16 | established in section 1518.1 (relating to emergency contact |
17 | database). |

2 | Section 2. Title 75 is amended by adding a section to read: |
3 | § 1518.1. Emergency contact database. |
4 | (a) Emergency contacts.--The department shall establish a |
5 | database of emergency contacts of persons who are issued a |
6 | driver's license, commercial driver's license, temporary |
7 | instruction permit or identification card. Information in the |
8 | database shall be accessible only to employees of the bureau and |
9 | to criminal justice agencies and is not public record pursuant |
10 | to Chapter 61 (relating to powers of department and local |
11 | authorities). |
12 | (b) Information.--An individual holding a driver's license, |
13 | commercial driver's license, temporary instruction permit or |
14 | identification card shall be afforded the opportunity to list |
15 | the name, address, telephone number and relationship to the |
16 | individual of at least one, but not to exceed three, contact |
17 | persons whom the individual wishes to be contacted if the |
18 | individual is involved in a motor vehicle accident or emergency |
19 | situation and the individual dies, is seriously injured or is |
20 | rendered unconscious and is unable to communicate with the |
21 | contact person. The contact person may or may not be the next of |
22 | kin of the applicant, except that if the applicant is under 18 |
23 | years of age and is not emancipated, the contact person shall |
24 | include the parent, guardian or custodian of the applicant. |
25 | (c) Duties of department.--The department shall adopt rules |
26 | to implement this section. The rules shall address both of the |
27 | following: |
28 | (1) The methods whereby a person who has submitted the |
29 | name of a contact person for inclusion in the database may |
30 | make changes to that entry. |

1 | (2) Any other aspect of the database or its operation |
2 | that the department determines necessary in order to |
3 | implement this section. |
4 | (d) Notification.--In the event of a motor vehicle accident |
5 | or emergency situation in which a person dies, is seriously |
6 | injured or is rendered unconscious and is unable to communicate |
7 | with the contact person specified in the database, an employee |
8 | of a criminal justice agency shall make a good faith effort to |
9 | notify the contact person of the situation, but the department, |
10 | the employee or the criminal justice agency that employs that |
11 | employee shall not incur any liability if the employee is not |
12 | able to make contact with the contact person. |
13 | (e) Rules and regulations.--The department shall adopt rules |
14 | and regulations establishing the emergency contact database and |
15 | the database shall be operational not later than 180 days after |
16 | the effective date of this section. |
17 | Section 3. This act shall take effect in 60 days. |
