AN ACT

Amending Title 23 (Domestic Relations) of the Pennsylvania

Consolidated Statutes, in child custody, further providing

for consideration of criminal conviction.

The General Assembly of the Commonwealth of Pennsylvania

hereby enacts as follows:

Section 1.  Section 5329(c) of Title 23 of the Pennsylvania

Consolidated Statutes is amended to read:

§ 5329.  Consideration of criminal conviction.

(c)  Initial evaluation.--The court [shall] may provide for

an evaluation to determine whether:

(1)  the party or household member who committed an

offense under subsection (a) poses a threat to the child; and

(2)  counseling is necessary for that party or household

member.

Section 2.  This act shall take effect in 60 days.
