| AN ACT |
| |
1 | Amending Titles 18 (Crimes and Offenses) and 42 (Judiciary and |
2 | Judicial Procedure) of the Pennsylvania Consolidated |
3 | Statutes, in computer offenses, providing for the offenses of |
4 | unlawful use of Internet and for unlawful use of computer |
5 | scrub software; further providing for definitions; in |
6 | registration of sexual offenders, further providing for |
7 | registration procedures and applicability; and providing for |
8 | limited Internet access and for prohibited use of computer |
9 | scrub software. |
10 | The General Assembly of the Commonwealth of Pennsylvania |
11 | hereby enacts as follows: |
12 | Section 1. The heading of Subchapter E of Chapter 76 of |
13 | Title 18 of the Pennsylvania Consolidated Statutes is amended to |
14 | read: |

18 | Section 2. Title 18 is amended by adding sections to read: |
19 | § 7662. Unlawful use of Internet. |
20 | (a) Offense defined.--A person commits the crime of unlawful |
21 | use of the Internet if the person is subject to registration |

1 | requirements under 42 Pa.C.S. § 9795.2(a) (relating to |
2 | registration procedures and applicability), as a condition of |
3 | parole or probation is prohibited from accessing the Internet, |
4 | social networking websites or other actions defined under 42 |
5 | Pa.C.S. § 9795.6 (relating to limited Internet access) and |
6 | violates that condition of parole or probation. |
7 | (b) Grading.--In addition to being subject to penalties |
8 | prescribed under section 4915 (relating to failure to comply |
9 | with registration of sexual offenders requirements) an offense |
10 | under this section shall constitute a felony of the third |
11 | degree. |
12 | (c) Definition.--As used in this section, the term |
13 | "commercial social networking site" means any business, |
14 | organization or other similar entity operating a website that |
15 | permits persons to become registered users for the purpose of |
16 | establishing personal relationships with other users through |
17 | direct or real-time communication with other users or the |
18 | creation of web pages or profiles available to the public or to |
19 | other users. The term does not include an electronic mail |
20 | program or a message board program. |
21 | § 7663. Unlawful use of computer scrub software. |
22 | (a) Offense defined.--A person commits the crime of unlawful |
23 | use of computer scrub software if the person is subject to |
24 | registration requirements under 42 Pa.C.S. § 9795.2(a) (relating |
25 | to registration procedures and applicability), as a condition of |
26 | parole or probation is prohibited from using computer scrub |
27 | software under 42 Pa.C.S. § 9795.7 (relating to prohibited use |
28 | of computer scrub software) and violates that condition of |
29 | parole or probation. |
30 | (b) Grading.--In addition to being subject to penalties |

1 | prescribed under section 4915 (relating to failure to comply |
2 | with registration of sexual offenders requirements), an offense |
3 | under this section shall constitute a misdemeanor of the third |
4 | degree. |
5 | (c) Definition.--As used in this section, the term "computer |
6 | scrub software" means any third-party added software, designed |
7 | to delete information from the computer unit, the hard drive or |
8 | other software, which would eliminate and prevent discovery of |
9 | browser activity, including Internet history, address bar, cache |
10 | and cookies and which would overwrite files in a way so as to |
11 | make previous computer activity, including website access, more |
12 | difficult to discover. |
13 | Section 3. Section 9792 of Title 42 is amended by adding |
14 | definitions to read: |
15 | § 9792. Definitions. |
16 | The following words and phrases when used in this subchapter |
17 | shall have the meanings given to them in this section unless the |
18 | context clearly indicates otherwise: |

20 | "Commercial social networking site." Any business, |
21 | organization or other similar entity operating a website that |
22 | permits persons to become registered users for the purpose of |
23 | establishing personal relationships with other users through |
24 | direct or real-time communication with other users or the |
25 | creation of web pages or profiles available to the public or to |
26 | other users. The term does not include an electronic mail |
27 | program or a message board program. |

29 | "Computer scrub software." Any third party added software |
30 | designed to delete information from the computer unit, the hard |

1 | drive or other software, which would eliminate and prevent |
2 | discovery of browser activity, including Internet history, |
3 | address bar, cache and cookies and which would overwrite files |
4 | so as to make previous computer activity, including website |
5 | access, more difficult to discover. |

7 | "Internet identifiers." Electronic mail addresses and |
8 | designations used for the purpose of chat, instant messaging, |
9 | social networking or other similar Internet communications. |
10 | "Internet service provider." A person who furnishes a |
11 | service that enables users to access content, information, |
12 | electronic mail or other services offered over the Internet and |
13 | proprietary content, information and other services as part of a |
14 | package of services offered to consumers. |

16 | Section 4. Sections 9795.2(a)(1) and (2) of Title 42 are |
17 | amended and the section is amended by adding a subsection to |
18 | read: |
19 | § 9795.2. Registration procedures and applicability. |
20 | (a) Registration.-- |
21 | (1) Offenders and sexually violent predators shall be |
22 | required to register with the Pennsylvania State Police upon |
23 | release from incarceration, upon parole from a State or |
24 | county correctional institution or upon the commencement of a |
25 | sentence of or not later than three days after being |
26 | sentenced to intermediate punishment or probation. For |
27 | purposes of registration, offenders and sexually violent |
28 | predators shall provide the Pennsylvania State Police with |
29 | the name of the offender, including all aliases used by the |
30 | offender, the Social Security number of the offender, all |

1 | current or intended residences, all information concerning |
2 | current or intended employment [and], all information |
3 | concerning current or intended enrollment as a student, the |
4 | license plate number and description of any vehicle owned or |
5 | operated by the offender and any accounts with Internet |
6 | service providers and Internet identifiers. |
7 | (2) Offenders and sexually violent predators shall |
8 | inform the Pennsylvania State Police within 48 hours of: |
9 | (i) Any change of residence or establishment of an |
10 | additional residence or residences. |
11 | (ii) Any change of employer or employment location |
12 | for a period of time that will exceed 14 days or for an |
13 | aggregate period of time that will exceed 30 days during |
14 | any calendar year, or termination of employment. |
15 | (iii) Any change of institution or location at which |
16 | the person is enrolled as a student, or termination of |
17 | enrollment. |
18 | (iv) Becoming employed or enrolled as a student if |
19 | the person has not previously provided that information |
20 | to the Pennsylvania State Police. |
21 | (v) Any changes of ownership, sale, transfer or |
22 | lease of motor vehicles. |
23 | (vi) Any changes made to license plates. |
24 | (vii) Any changes of accounts with Internet service |
25 | providers. |
26 | (viii) Any changes to or additional Internet |
27 | identifiers. |

29 | (c.1) Registration information provided to Internet service |
30 | providers.-- |

1 | (1) The Pennsylvania State Police shall, upon the |
2 | request of any Internet service provider, release to the |
3 | entity Internet identifiers that would enable the entity to |
4 | prescreen or remove sex offenders from its services or, in |
5 | conformity with the laws of this Commonwealth and the United |
6 | States, advise law enforcement or other governmental entities |
7 | of potential violations of the law. |
8 | (2) Before releasing any information the Pennsylvania |
9 | State Police shall require the Internet service provider that |
10 | requests the information from the registry to submit the |
11 | name, address and telephone number of the requesting entity, |
12 | the specific legal nature and status of the entity and any |
13 | additional information deemed necessary by the Pennsylvania |
14 | State Police. |
15 | (3) Except for the purposes specified under this |
16 | section, an Internet service provider shall not publish or in |
17 | any way disclose or redisclose any information provided by |
18 | the Pennsylvania State Police. |
19 | (4) The Pennsylvania State Police shall promulgate rules |
20 | and regulations relating to procedures for the release of |
21 | information, including the disclosure and redisclosure of the |
22 | information. |

24 | Section 5. Title 42 is amended by adding sections to read: |
25 | § 9795.6 Limited Internet access. |
26 | (a) General.--A person subject to the registration |
27 | requirements of this subchapter who has committed any offense |
28 | under section 9795.1 (relating to registration) or has used the |
29 | Internet to facilitate commission of any offense under section |
30 | 9795.1 shall be prohibited from using the Internet for purposes |

1 | under subsection (b). |
2 | (b) Prohibition of Internet usage as a condition of parole |
3 | or probation.--As a condition of parole or probation, the courts |
4 | may impose a prohibition on any use of Internet by any person |
5 | subject to the registration requirements of this subchapter who |
6 | has used the Internet to facilitate commission of any offense |
7 | under section 9795.1. |
8 | (c) Limited uses of the Internet.--A person subject to the |
9 | registration requirements under section 9795.1 is prohibited |
10 | from using the Internet for the following purposes: |
11 | (1) To access pornographic material including material |
12 | described under 18 Pa.C.S. § 6312(d) (relating to sexual |
13 | abuse of children). |
14 | (2) To access a commercial social networking website. |
15 | (3) To communicate with other individuals or groups for |
16 | the purpose of promoting sexual relations with persons under |
17 | 18 years of age when the offender has committed any of the |
18 | following offenses: |
19 | 18 Pa.C.S. § 2901 (relating to kidnapping) where the |
20 | victim is a minor. |
21 | 18 Pa.C.S. § 2910 (relating to luring a child into a |
22 | motor vehicle or structure). |
23 | 18 Pa.C.S. § 4302 (relating to incest) where the |
24 | victim is 12 years of age or older but under 18 years of |
25 | age. |
26 | 18 Pa.C.S. § 5902(b) (relating to prostitution and |
27 | related offenses) where the actor promotes the |
28 | prostitution of a minor. |
29 | 18 Pa.C.S. § 5903(a)(3), (4), (5) or (6) (relating to |
30 | obscene and other sexual materials and performances) |

1 | where the victim is a minor. |
2 | 18 Pa.C.S. § 6312. |
3 | 18 Pa.C.S. § 6318 (relating to unlawful contact with |
4 | minor). |
5 | 18 Pa.C.S. § 6320 (relating to sexual exploitation of |
6 | children). |
7 | (4) To communicate with a person under 18 years of age |
8 | when the offender has committed any of the following |
9 | offenses: |
10 | 18 Pa.C.S. § 2901 where the victim is a minor. |
11 | 18 Pa.C.S. § 2910. |
12 | 18 Pa.C.S. § 4302 where the victim is 12 years of age |
13 | or older but under 18 years of age. |
14 | 18 Pa.C.S. § 5902(b) where the actor promotes the |
15 | prostitution of a minor. |
16 | 18 Pa.C.S. § 5903(a)(3), (4), (5) or (6) where the |
17 | victim is a minor. |
18 | 18 Pa.C.S. § 6312. |
19 | 18 Pa.C.S. § 6318. |
20 | 18 Pa.C.S. § 6320. |
21 | § 9795.7 Prohibited use of computer scrub software. |
22 | (a) General.--A person subject to the registration |
23 | requirements of this subchapter who has committed any offense |
24 | under section 9795.1 (relating to registration) or has used a |
25 | computer to facilitate commission of any offense under section |
26 | 9795.1 shall be prohibited from using the computer scrub |
27 | software. |
28 | (b) Prohibition of computer scrub software usage as a |
29 | condition of parole or probation.--As a condition of parole or |
30 | probation, the courts may impose a prohibition on any use of |

1 | computer scrub software by any person subject to the |
2 | registration requirements of this subchapter who has used a |
3 | computer to facilitate commission of any offense under section |
4 | 9795.1. |
5 | Section 6. This act shall take effect in 60 days. |
