| AN ACT |
| |
1 | Amending Title 75 (Vehicles) of the Pennsylvania Consolidated |
2 | Statutes, further providing for the registered gross weight |
3 | limit of certain registration plates, in fees, further | <-- |
4 | providing for annual hauling permits; further providing for |
5 | use and display of illuminated signs; in excessive size and |
6 | weight permits, providing for permits to move eggs; and |
7 | making an editorial change. |
8 | The General Assembly of the Commonwealth of Pennsylvania |
9 | hereby enacts as follows: |
10 | Section 1. Sections 1307(a.1), 1338(a)(9), 1341, 1342(a), |
11 | (c) and (d), 1346, 1348, 1350, 1350.1, 1351, 1352, 1353, |
12 | 1354(a), 1355, 1356, 1357, 1358, 1359(a), 1360, 1362, 1363, 1364 |
13 | and 1365(a) of Title 75 of the Pennsylvania Consolidated |
14 | Statutes are amended to read: |
15 | § 1307. Period of registration. |
16 | * * * |
17 | (a.1) Seasonal registration.--Upon application on a form |
18 | prescribed by the department, the owner or lessee of a passenger |
|
1 | car, recreational motor vehicle, motorcycle, truck [or], or farm | <-- |
2 | vehicle or antique, classic and collectible vehicle which does | <-- |
3 | not have a gross vehicle weight rating of more than [10,000] |
4 | 14,000 pounds may register the vehicle with the department for a |
5 | period of successive months of less than one year. The applicant |
6 | shall specify the period of months during which the vehicle |
7 | shall be registered. Except when the department initially |
8 | converts a currently valid annual registration to a seasonal |
9 | registration, the annual fee prescribed for the vehicle by |
10 | Chapter 19 (relating to fees) shall be paid in full by the |
11 | applicant regardless of the number of months chosen for |
12 | registration by the applicant. Upon receipt of the appropriate |
13 | fee and the properly completed form, including all information |
14 | required by this chapter, the department shall issue a seasonal |
15 | registration that shall expire on the last day of the expiration |
16 | month chosen by the registrant. No insurer of a vehicle |
17 | belonging to any owner or lessee who obtains a seasonal |
18 | registration and who applies for or receives a reduced |
19 | automobile insurance premium on account thereof shall be |
20 | required to provide any contractual coverage, whether in the |
21 | form of the provision of a defense or the payment of first-party |
22 | or third-party benefits or otherwise, to the owner or lessee in |
23 | connection with any event occurring during that part of the year |
24 | in which the vehicle is not registered; and such owner or lessee |
25 | shall be treated for all purposes, including, without |
26 | limitation, ascertaining rights to stack coverages and to |
27 | uninsured and underinsured motorist coverage, as a person who |
28 | does not own that vehicle and has no duty to carry financial |
29 | responsibility on it for that part of the year. |

1 | § 1338. Person with disability plate and placard. |
2 | (a) Person with disability plate.--On the application of any |
3 | person who: |
4 | * * * |
5 | (9) is a person in loco parentis of a person specified |
6 | in paragraph (1), (2), (3), (4), (5), (6), (7) or (8); |
7 | the department shall issue a special registration plate for one |
8 | passenger car or truck with a registered gross weight of not |
9 | more than [10,000] 14,000 pounds, designating the vehicle so |
10 | licensed as being used by a person with a disability. Special |
11 | plates for persons with disabilities may also be issued for |
12 | vehicles operated exclusively for the use and benefit of persons |
13 | with disabilities. In the case of a motorcycle, the department |
14 | shall issue a decal containing the international symbol for |
15 | access for persons with disabilities for display on the |
16 | registration plate. |

18 | § 1341. Special registration plates generally. |
19 | Upon request by the applicant, the department may issue |
20 | registration plates consisting of any combination of numbers, |
21 | letters or numbers and letters. These special plates may be |
22 | issued for special groups or for special purposes and bear an |
23 | appropriate designation. Special groups may charge a fee for |
24 | authorization to request a registration plate bearing the name |
25 | of the group. They shall have the same force and effect as |
26 | regular registration plates. The department may refuse any |
27 | combination of letters and numbers for cause and shall adopt |
28 | reasonable rules and regulations for the issuance of the plates |
29 | and for carrying out the provisions of this section. The |
30 | applicant shall comply with all laws and regulations pertaining |

1 | to registration including the payment of any additional fees. |
2 | The department is authorized to reissue a combination of numbers |
3 | or letters for a personal plate if the department records reveal |
4 | that no activity, such as renewal or transfer of the personal |
5 | registration plate, has occurred for a period of five or more |
6 | consecutive years and provided that the personal registration |
7 | plate was never reported as lost or stolen. Whenever the |
8 | department reissues an inactive personal plate, the department |
9 | may purge its records of all references to the previous owners |
10 | of that personal plate. The department shall, however, note upon |
11 | its records the reissuance of the personal plate and to whom the |
12 | plate was issued. The special registration plate may be used |
13 | only on a passenger car or truck with a registered gross weight |
14 | of not more than [10,000] 14,000 pounds. If the vehicle is |
15 | licensed to a business that is not a member of the special |
16 | group, the department shall issue the plate as long as the |
17 | business owner or officer making application is a member of that |
18 | group. |
19 | § 1342. Veteran plates and placard. |
20 | (a) Severely disabled veteran plate.--On the application of |
21 | a veteran whose service-connected disability is certified at |
22 | 100% by the service unit of the armed forces in which the |
23 | veteran served or by the United States Veterans' Administration |
24 | or who has a service-connected disability of the type enumerated |
25 | in section 1338 (relating to person with disability plate and |
26 | placard), the department shall issue a special registration |
27 | plate designating the vehicle as belonging to a severely |
28 | disabled veteran. The registration plate shall have a white |
29 | background, shall have blue numbers or letters as the department |
30 | may determine, shall have the words "disabled veteran" in at |

1 | least ten-point bold type inscribed in red at the bottom of the |
2 | plate and shall include the international symbol for access for |
3 | persons with disabilities. Only one special registration plate |
4 | shall be issued to a veteran under this section. It may be used |
5 | only on a passenger car or truck with a registered gross weight |
6 | of not more than [10,000] 14,000 pounds. In the case of a |
7 | motorcycle, the department shall issue a decal containing the |
8 | international symbol for access for persons with disabilities |
9 | and the words "disabled veteran" for display on the registration |
10 | plate. |

12 | (c) Disabled veteran plates.--On the application of any |
13 | veteran having a disability certified by the service unit of the |
14 | armed forces in which the veteran served or by the United States |
15 | Veterans' Administration as service-connected, the department |
16 | shall issue a special registration plate designating the vehicle |
17 | as belonging to a disabled veteran. The registration plate shall |
18 | have a white background, shall have numbers or letters as the |
19 | department may determine and shall have the words "disabled |
20 | veteran" in at least ten-point bold type inscribed at the bottom |
21 | of the plate. Only one special registration plate shall be |
22 | issued to a veteran under this section. It may be used only on a |
23 | passenger car or truck with a registered gross weight of not |
24 | more than [10,000] 14,000 pounds. |
25 | (d) Prisoner of war plate.--On the application of an ex- |
26 | prisoner of war whose imprisonment while in the service of the |
27 | armed forces of the United States is certified by the |
28 | appropriate branch of the armed forces, the department shall |
29 | issue a special registration plate designating the vehicle as |
30 | belonging to an ex-prisoner of war. The registration plate shall |

1 | contain the letters "POW" and such other numbers or letters as |
2 | the department may determine and shall have the words "prisoner |
3 | of war" in at least ten-point bold type inscribed at the bottom |
4 | of the plate. Only one special registration plate shall be |
5 | issued to an ex-prisoner of war under this subsection. The |
6 | special registration plate may be used only on a passenger car |
7 | or truck with a registered gross weight of not more than |
8 | [10,000] 14,000 pounds. |

10 | § 1346. Special plates for recipients of Purple Heart. |
11 | Upon application of any person who is a recipient of the |
12 | Purple Heart, the department shall issue to such person a |
13 | special registration plate designating the vehicle so licensed |
14 | as belonging to a person who is a recipient of the Purple Heart. |
15 | A severely disabled veteran, as described in section 1342(a) |
16 | (relating to veteran plates and placard), who is qualified to |
17 | receive a plate under this section may also elect to receive a |
18 | placard under section 1342(b). The special registration plate |
19 | may be used only on a passenger car or truck with a registered |
20 | gross weight of not more than [10,000] 14,000 pounds. |
21 | § 1348. Special plates for Pearl Harbor survivors. |
22 | Upon application of any person who is a survivor of Pearl |
23 | Harbor, accompanied by a fee of $20 which shall be in addition |
24 | to the annual registration fee and by such documentation as the |
25 | department shall require, the department shall issue to such |
26 | person a special registration plate designating the vehicle so |
27 | licensed as belonging to a person who is a survivor of Pearl |
28 | Harbor. The special registration plate may be used only on a |
29 | passenger car or truck with a registered gross weight of not |
30 | more than [10,000] 14,000 pounds. |

1 | § 1350. Special plates for veterans of Korean War. |
2 | Upon application of any person who is a veteran of the Korean |
3 | War, accompanied by a fee of $20, which shall be in addition to |
4 | the annual registration fee, and by such documentation as the |
5 | department shall require, the department shall issue to the |
6 | person a special registration plate designating the vehicle so |
7 | licensed as belonging to a person who is a veteran of the Korean |
8 | War. The special registration plate may be used only on a |
9 | passenger car or truck with a registered gross weight of not |
10 | more than [10,000] 14,000 pounds. |
11 | § 1350.1. Special plates for recipients of Korean Defense |
12 | Service Medal. |
13 | Upon application of any person who is a recipient of the |
14 | Korean Defense Service Medal, accompanied by a fee of $20 which |
15 | shall be in addition to the annual registration fee and by such |
16 | documentation as the department shall require, the department |
17 | shall issue to the person a special registration plate |
18 | designating the vehicle so licensed as belonging to a person who |
19 | is a recipient of the Korean Defense Service Medal. The |
20 | department shall design and produce the special registration |
21 | plate. The special registration plate may be used only on a |
22 | passenger car or truck with a registered gross weight of not |
23 | more than [10,000] 14,000 pounds. |
24 | § 1351. Special plates for veterans of Persian Gulf War. |
25 | Upon application of any person who is a veteran of the |
26 | Persian Gulf War, accompanied by a fee of $20, which shall be in |
27 | addition to the annual registration fee, and by such |
28 | documentation as the department shall require, the department |
29 | shall issue to the person a special registration plate |
30 | designating the vehicle so licensed as belonging to a person who |

1 | is a veteran of the Persian Gulf War. The special registration |
2 | plate may be used only on a passenger car or truck with a |
3 | registered gross weight of not more than [10,000] 14,000 pounds. |
4 | § 1352. Wild resource conservation plate. |
5 | The department, in consultation with the Wild Resource |
6 | Conservation Board, shall design a special wild resource |
7 | conservation registration plate. Upon application of any person, |
8 | accompanied by a fee of $35 which shall be in addition to the |
9 | annual registration fee, the department shall issue the plate |
10 | for a passenger car, motor home, trailer or truck with a |
11 | registered gross weight of not more than [10,000] 14,000 pounds. |
12 | The Wild Resource Conservation Fund shall receive $15 of each |
13 | additional fee for this plate. |
14 | § 1353. Preserve our heritage registration plate. |
15 | The department, in consultation with the Pennsylvania |
16 | Historical and Museum Commission, shall design a special |
17 | preserve our heritage registration plate. Upon receipt of an |
18 | application, accompanied by a fee of $35 which shall be in |
19 | addition to the annual registration fee, the department shall |
20 | issue the plate for a passenger car, motor home, trailer or |
21 | truck with a registered gross weight of not more than [10,000] |
22 | 14,000 pounds. The Historical Preservation Fund shall receive |
23 | $15 of each additional fee for this plate. |
24 | § 1354. Flagship Niagara commemorative registration plate. |
25 | (a) Plate.--The department, in consultation with the |
26 | Pennsylvania Historical and Museum Commission, shall design a |
27 | Flagship Niagara commemorative registration plate. Upon |
28 | application of any person, accompanied by a fee of $35 which |
29 | shall be in addition to the annual registration fee, the |
30 | department shall issue the plate for a passenger car, motor |

1 | home, trailer or truck with a registered gross weight of not |
2 | more than [10,000] 14,000 pounds. |

4 | § 1355. Zoological plate. |
5 | The department, in consultation with the Pennsylvania |
6 | Zoological Council, shall design a special zoological |
7 | registration plate. Upon application of any person, accompanied |
8 | by a fee of $35 which shall be in addition to the annual |
9 | registration fee, the department shall issue the plate for a |
10 | passenger car, motor home, trailer or truck with a registered |
11 | gross weight of not more than [10,000] 14,000 pounds. The |
12 | Zoological Enhancement Fund shall receive $15 of the fee paid by |
13 | the applicant for the plate. |
14 | § 1356. Special plates for recipients of Expeditionary Forces |
15 | Medal. |
16 | Upon application of any person who is a recipient of the |
17 | Expeditionary Forces Medal, accompanied by a fee of $20 which |
18 | shall be in addition to the annual registration fee and by such |
19 | documentation as the department shall require, the department |
20 | shall issue to such person a special registration plate |
21 | designating the vehicle so registered as belonging to a person |
22 | who is a recipient of the Expeditionary Forces Medal. The |
23 | special registration plate may be used only on a passenger car |
24 | or truck with a registered gross weight of not more than |
25 | [10,000] 14,000 pounds. |
26 | § 1357. Special plates for World War II veterans. |
27 | Upon application of any person who is a veteran of World War |
28 | II, accompanied by a fee of $20 which shall be in addition to |
29 | the annual registration fee and by such documentation as the |
30 | department shall require, the department shall issue to such |

1 | person a special registration plate carrying the symbol of a |
2 | ruptured duck designating the vehicle so registered as belonging |
3 | to a person who is a veteran of World War II. The special |
4 | registration plate may be used only on a passenger car or truck |
5 | with a registered gross weight of not more than [10,000] 14,000 |
6 | pounds. |
7 | § 1358. DARE plate. |
8 | The department, in consultation with the Pennsylvania |
9 | Commission on Crime and Delinquency, shall design a special drug |
10 | abuse resistance education (DARE) registration plate which |
11 | utilizes the DARE logo or slogan in the design. Upon application |
12 | of any person, accompanied by a fee of $35 which shall be in |
13 | addition to the annual registration fee, the department shall |
14 | issue the plate for a passenger car, motor home, trailer or |
15 | truck with a registered gross weight of not more than [10,000] |
16 | 14,000 pounds. The Drug Abuse Resistance Education Program shall |
17 | receive $15 of each additional fee for this plate. |
18 | § 1359. Special plates for steelworkers. |
19 | (a) General rule.--Upon application of any person who is a |
20 | steelworker, accompanied by a fee of $20 which shall be in |
21 | addition to the annual registration fee and by such |
22 | documentation as the department shall require, the department |
23 | shall issue to such person a special registration plate |
24 | designating the vehicle so licensed as belonging to a person who |
25 | is a steelworker. The special registration plate may be used |
26 | only on a passenger car or a truck with a registered gross |
27 | weight of not more than [10,000] 14,000 pounds. The plate shall |
28 | bear the likeness of the official emblem of the American Iron |
29 | and Steel Institute. |

1 | § 1360. Special plates for veterans of Vietnam Conflict. |
2 | Upon application of any person who is a veteran of the |
3 | Vietnam Conflict as that term is defined for the awarding of the |
4 | Vietnam Service Medal, accompanied by a fee of $20 in addition |
5 | to the annual registration fee and by such documentation as the |
6 | department shall require, the department shall issue to the |
7 | person a special registration plate designating the vehicle so |
8 | licensed as belonging to a person who is a veteran of the |
9 | Vietnam Conflict. The special registration plate may be used |
10 | only on a passenger car or truck with a registered gross weight |
11 | of not more than [10,000] 14,000 pounds. |
12 | § 1362. Operation Iraqi Freedom veterans plate. |
13 | Upon application of any person who is a veteran of the |
14 | liberation or occupation of Iraq, accompanied by a fee of $20 |
15 | which shall be in addition to the annual registration fee and by |
16 | documentation as the department shall require, the department |
17 | shall issue to the person a special registration plate |
18 | designating the vehicle so licensed as belonging to a person who |
19 | is a veteran of Operation Iraqi Freedom. The special |
20 | registration plate may be used only on a passenger car or truck |
21 | with a registered gross weight of not more than [10,000] 14,000 |
22 | pounds. |
23 | § 1363. Operation Enduring Freedom veterans plate. |
24 | Upon application of any person who is a veteran of the |
25 | liberation or occupation of Afghanistan, accompanied by a fee of |
26 | $20 which shall be in addition to the annual registration fee |
27 | and by documentation as the department shall require, the |
28 | department shall issue to the person a special registration |
29 | plate designating the vehicle so licensed as belonging to a |
30 | person who is a veteran of Operation Enduring Freedom. The |

1 | special registration plate may be used only on a passenger car |
2 | or truck with a registered gross weight of not more than |
3 | [10,000] 14,000 pounds. |
4 | § 1364. Special plates for veterans. |
5 | Upon application of any person who is an honorably discharged |
6 | veteran of the armed forces of the United States or a reserve |
7 | component of the armed forces as defined in 51 Pa.C.S. § 7301 |
8 | (relating to definitions), accompanied by a fee of $20 which |
9 | shall be in addition to the annual registration fee and by such |
10 | documentation as the department shall require, the department |
11 | shall issue to the person a special registration plate |
12 | designating the vehicle as belonging to a person who is a |
13 | veteran of the armed forces of the United States. The special |
14 | registration plate may be used only on a passenger car or truck |
15 | with a registered gross weight of not more than [10,000] 14,000 |
16 | pounds. |
17 | § 1365. Gold Star Family plate. |
18 | (a) General rule.--Upon application of a family member of a |
19 | person who was killed while serving on active duty in the |
20 | military, accompanied by a fee of $20 which shall be in addition |
21 | to the annual registration fee and by such documentation as the |
22 | department shall require, the department shall issue to the |
23 | family member a special registration plate designating the |
24 | vehicle so licensed as belonging to a family member of a person |
25 | who was killed while serving on active duty in the military. The |
26 | department shall design and produce the special registration |
27 | plate carrying the Service Flag Gold Star rimmed with blue which |
28 | represents sacrifice to the cause of liberty and freedom. The |
29 | words "Gold Star Family" shall be clearly displayed along the |
30 | bottom of the plate. The special registration plate may be used |

1 | only on a passenger car or truck with a registered gross weight |
2 | of not more than [10,000] 14,000 pounds. |

4 | Section 2. Section 1943 of Title 75 is amended by adding a | <-- |
5 | subsection to read: |
6 | § 1943. Annual hauling permits. |

8 | (g.1) Eggs.--The annual fee for movement of each vehicle |
9 | hauling eggs as provided for in section 4976.2 (relating to |
10 | permit for movement of eggs) shall be $400. |

12 | Section 3. Sections 4307(a) and 4962(f) of Title 75 are |
13 | amended to read: |
14 | § 4307. Use and display of illuminated signs. |
15 | (a) General rule.--[Except as otherwise provided in this |
16 | section, no vehicle shall bear or display any illuminated signs, |
17 | letters, numerals or figures of any kind whatsoever.] Except as |
18 | otherwise provided in this section, any lighted lamp or |
19 | illuminating device upon a motor vehicle, other than head lamps, |
20 | spot lamps, auxiliary lamps, flashing turn signals, emergency |
21 | vehicle warning lamps and school bus warning lamps, which |
22 | projects a beam of light of an intensity no greater than 100 |
23 | candela shall be so directed that no part of the high intensity |
24 | portion of the beam will strike the level of the roadway on |
25 | which the vehicle stands at a distance of more than 75 feet from |
26 | the vehicle. The device should measure no greater than a 5.5 |
27 | inch width x 4.5 inch height or 5-inch circumference for round |
28 | versions and be located in rear corner or rear-side corner |
29 | windows only as not to obstruct the driver's view. Flashing |
30 | lights are prohibited on motor vehicles, motorcycles and |

1 | motor‑drawn vehicles except as a means for indicating a right or |
2 | left turn. No person shall drive or move upon any highway any |
3 | vehicle or equipment with any lamp or device thereon displaying |
4 | a red light visible from directly in front of the center |
5 | thereof. |

7 | § 4962. Conditions of permits and security for damages. |

9 | (f) When loads permitted.--Only vehicles and combinations |
10 | permitted under the following provisions shall be authorized to |
11 | carry or haul loads while operating under the permit: |
12 | Section 4961(a)(2), (3) and (6) (relating to authority to |
13 | issue permits). |
14 | Section 4965 (relating to single permits for multiple |
15 | highway crossings). |
16 | Section 4968 (relating to permit for movement during |
17 | course of manufacture). |
18 | Section 4974 (relating to permit for movement of |
19 | containerized cargo). |
20 | Section 4975 (relating to permit for movement of special |
21 | mobile equipment). |
22 | Section 4976 (relating to permit for movement of domestic |
23 | animal feed). |
24 | Section 4976.1 (relating to permit for movement of live |
25 | domestic animals). |
26 | Section 4976.2 (relating to permit for movement of eggs). |
27 | Section 4977 (relating to permit for movement of wooden |
28 | structures). |
29 | Section 4978 (relating to permit for movement of building |
30 | structural components). |

1 | Section 4979 (relating to permit for movement of |
2 | particleboard or fiberboard used in the manufacture of ready- |
3 | to-assemble furniture). |
4 | Section 4979.1 (relating to permit for movement of bulk |
5 | refined oil). |
6 | Section 4979.2 (relating to permit for movement of waste |
7 | coal and beneficial combustion ash). |
8 | Section 4979.3 (relating to permit for movement of float |
9 | glass or flat glass for use in construction and other end |
10 | uses). |
11 | Section 4979.4 (relating to permit for movement of self- |
12 | propelled cranes). |
13 | Section 4979.5 (relating to permit for movement of |
14 | nonhazardous liquid glue). |
15 | Section 4979.6 (relating to permit for movement of waste |
16 | tires). |

18 | Section 4. Title 75 is amended by adding a section to read: |
19 | § 4976.2. Permit for movement of eggs. |
20 | (a) Authorization.--Except as set forth in subsection (b), |
21 | all of the following apply: |
22 | (1) An annual permit may be issued authorizing the |
23 | movement on highways to haul eggs to or from a processor by |
24 | a combination of vehicles which exceeds the maximum vehicle |
25 | gross weight specified in Subchapter C (relating to maximum |
26 | weights of vehicles). |
27 | (2) On a vehicle permitted under this section: |
28 | (i) overall gross weight may not exceed 95,000 |
29 | pounds; and |
30 | (ii) weight on a nonsteering axle may not exceed |

1 | 21,000 pounds. |
2 | (b) Exception.--No permit may be issued for this type of |
3 | movement upon an interstate highway. |
4 | Section 2 5. This act shall take effect in 60 days. | <-- |
