AN ACT

Amending Title 42 (Judiciary and Judicial Procedure) of the

2

Pennsylvania Consolidated Statutes, further providing for

3

Good Samaritan civil immunity relating to automated external

4

defibrillators.

5

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

7

Section 1.  Section 8331.2 of Title 42 of the Pennsylvania

8

Consolidated Statutes is amended to read:

9

§ 8331.2.  Good Samaritan civil immunity for use of automated

10

external defibrillator.

(a)  General rule.--[Except as otherwise provided in this

12

section, any individual who is trained to use an automated

13

external defibrillator in accordance with subsection (c) and]

14

Any individual or entity who in good faith uses, acquires or

15

maintains an AED [in an emergency] shall not be liable for any

16

civil damages as a result of any acts or omissions by such

17

individual or entity in using, acquiring or maintaining the AED,

18

except any acts or omissions intentionally designed to harm or

any grossly negligent acts or omissions which result in harm to

2

the individual receiving the AED treatment.

(b)  Requirements.--Any [person] individual or entity who

4

acquires and maintains an AED for use in accordance with this

5

section shall [not be liable for civil damages provided that the

6

person]:

7

(1)  [Ensures] Ensure that expected AED users receive

8

training pursuant to subsection (c).

9

(2)  [Maintains and tests] Maintain and test the AED

10

according to the manufacturer's operational guidelines.

11

(3)  [Provides] Provide instruction requiring the user of

12

the AED to utilize available means to immediately contact and

13

activate the emergency medical services system.

14

(4)  [Assures] Assure that any appropriate data or

15

information is made available to emergency medical services

16

personnel or other health care providers as requested.

17

(c)  Training.--For purposes of this section, expected AED

18

users shall complete training in the use of an AED provided by

19

the American National Red Cross or the American Heart

20

Association or through an equivalent course of instruction

21

approved by the Department of Health in consultation with a

22

technical committee of the Pennsylvania Emergency Health

23

Services Council.

(d)  Obstruction of emergency medical services personnel.--

25

Nothing in this section shall relieve a person who uses an AED

26

from civil damages when that person obstructs or interferes with

27

care and treatment being provided by emergency medical services

28

personnel or a health professional.

29

(e)  Exception.--Any individual or entity who fails to meet

30

the requirements set forth in subsection (b) or an individual

who lacks the training set forth in subsection (c) [but who has

2

access to an AED and in good faith uses an AED in an emergency

3

as an ordinary, reasonably prudent individual would do under the

4

same or similar circumstances] shall receive immunity from civil

5

damages as set forth in subsection (a), unless the individual or

6

entity acts in a willful and wanton or reckless manner.

(f)  Definitions.--As used in this section, the following

8

words and phrases shall have the meanings given to them in this

9

subsection:

"Automated external defibrillator" or "AED."  A portable

11

device that uses electric shock to restore a stable heart rhythm

12

to an individual in cardiac arrest.

13

"Emergency."  A situation where an individual is believed to

14

be in cardiac arrest and in need of immediate medical attention

15

to prevent death or serious injury.

16

"Good faith."  Includes a reasonable opinion that the

17

immediacy of the situation is such that the use of an AED should

18

not be postponed until emergency medical services personnel

19

arrive or the person is hospitalized.

20

Section 2.  This amendatory act shall apply to all causes of

21

action arising after June 30, 2010.

22

Section 3.  This act shall take effect immediately.
