AN ACT

Amending Title 42 (Judiciary and Judicial Procedure) of the

Pennsylvania Consolidated Statutes, further providing for

3

right to bail.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 5701 of Title 42 of the Pennsylvania

7

Consolidated Statutes is amended to read:

8

§ 5701.  Right to bail.

9

All prisoners shall be bailable by sufficient sureties,

10

unless:

11

(1)  for capital offenses or for offenses for which the

12

maximum sentence is life imprisonment; or

13

(2)  no condition or combination of conditions other than

14

imprisonment will reasonably assure the safety of any person

15

and the community when the proof is evident or presumption

16

great. [Excessive bail shall not be required.]

17

Section 2.  This act shall take effect immediately.
