AN ACT

Amending Title 75 (Vehicles) of the Pennsylvania Consolidated

2

Statutes, further providing for traffic-control signals.

The General Assembly of the Commonwealth of Pennsylvania

4

hereby enacts as follows:

5

Section 1.  Section 3112 of Title 75 of the Pennsylvania

6

Consolidated Statutes is amended by adding a subsection to read:

7

§ 3112.  Traffic-control signals.

(b.1)  Pedalcycle or motorcycle.--Notwithstanding any

10

provision of law to the contrary, the driver of a pedalcycle or

11

motorcycle approaching an intersection that is controlled by a

12

traffic-control signal utilizing a vehicle detection device that

is inoperative due to the size of the pedalcycle or motorcycle

2

shall come to a full and complete stop at the intersection and,

3

after exercising due care as provided by law, may proceed with

4

due caution when it is safe to do so. It is not a A defense to a

violation of subsection (a)(3) that is precluded where the

<--

6

driver of a pedalcycle or motorcycle proceeded under the belief

7

that a traffic-control signal utilized a vehicle detection

8

device or was inoperative failed to operate due to the size of

<--

9

the pedalcycle or motorcycle when the signal did not utilize a

10

vehicle detection device or that any device was did not in fact

<--

11

inoperative operate due to the size of the pedalcycle or

<--

12

motorcycle.

Section 2.  This act shall take effect in 60 days.
