AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, further providing for the requirement for use of 3 "miscellaneous motor vehicle business" registration plates. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 1337 of Title 75 of the Pennsylvania 7 Consolidated Statutes is amended to read: 8 § 1337. Use of "Miscellaneous Motor Vehicle Business" 9 registration plates. 10 (a) General rule.--The department shall issue to owners of 11 miscellaneous motor vehicle businesses with established places 12 of business special registration plates which may be displayed 13 on vehicles operated on highways in lieu of registering each 14 vehicle individually. Registration plates issued under this 15 section may be displayed upon vehicles only as provided for each 16 of the following classes of miscellaneous motor vehicle 17 business: 18 (1) For a repair or towing business:
1 (i) upon vehicles being used in the conduct of the 2 repair business to retrieve, tow or deliver other 3 vehicles or parts; and 4 (ii) upon vehicles being repaired. 5 (2) For a vehicle salvage dealer business: 6 (i) upon vehicles being used in the conduct of the 7 vehicle salvage dealer's business to retrieve or deliver 8 vehicles, vehicle hulks, parts or materials; and 9 (ii) upon vehicles being transported on their own 10 wheels for the purpose of being dismantled or recycled. 11 (3) For a transporter business upon vehicles being 12 transported on their own wheels in the conduct of the 13 transporter business. 14 (4) For a financier or collector-repossessor business: 15 (i) upon vehicles being used to pick up vehicles 16 that are being repossessed; and 17 (ii) upon vehicles being repossessed. 18 (5) For a watercraft trailer business: 19 (i) upon trailers used for the delivery of a new 20 boat to its purchaser; 21 (ii) upon trailers used for the transport of a used 22 boat which is to be resold by the dealer; and 23 (iii) upon trailers used for the transport of boats 24 by a dealer to or from another boat dealer, warehouse, 25 storage facility, boat show or repair facility or to and 26 from a location where a boat is to be demonstrated, 27 tested or inspected. 28 (5.1) For an automotive detailing and cosmetic grooming 29 business: 30 (i) upon vehicles being used in the conduct of the 20070H0172B0198 - 2 -
1 automotive detailing and cosmetic grooming business to 2 retrieve or deliver vehicles, parts or materials; and 3 (ii) upon vehicles being transported on their own 4 wheels for the purpose of being detailed or groomed. 5 (6) For all classes of miscellaneous motor vehicle 6 businesses upon vehicles used for the personal pleasure or 7 use of the owner of the miscellaneous motor vehicle business 8 or members of the owner's immediate family, or when the 9 business is a corporation, upon vehicles used for the 10 pleasure or use of not more than three officers or members of 11 the officer's immediate family or for the personal use of the 12 regular employees of the business when operated by the 13 employee. 14 All vehicles specified in paragraphs (1)(i), (2)(i), (4)(i), 15 (5.1)(i) and (6) must be titled in the name of the business or 16 family member and sales tax must be paid. 17 (b) Application for registration.--Application for 18 registration in any of the "Miscellaneous Motor Vehicle 19 Business" classes shall be made upon a form provided by the 20 department and shall set forth the full name and business 21 address of the applicant and such other information as the 22 department shall require. The application shall be verified by 23 the oath or affirmation of the applicant or, if the applicant is 24 a partnership or a corporation, by a partner or officer. 25 (c) Classes of "Miscellaneous Motor Vehicle Business".-- 26 (1) Repair or towing.--Any person regularly engaged in 27 the business of mechanical or body repairs or towing for 28 direct compensation of motor vehicles owned and operated by 29 other persons. 30 (2) Vehicle salvage dealer.--Any person regularly 20070H0172B0198 - 3 -
1 engaged in the business of acquiring and dismantling used, 2 wrecked, damaged, abandoned or salvage vehicles for the 3 purpose of selling the usable parts and selling the remaining 4 vehicle hulk materials for recycling or processing. 5 (3) Transporter.--Any person regularly engaged in the 6 business of transporting new or used vehicles on their own 7 wheels, owned by or in possession of a manufacturer or 8 dealer. 9 (4) Financier or collector-repossessor.--Any person who 10 is duly authorized by the Department of Banking to do 11 business in this Commonwealth as a financier or collector- 12 repossessor and who is regularly engaged in the business of 13 financing sales, making loans on the security of vehicles or 14 repossessing vehicles which are the subject of installment 15 sales contracts as an independent contractor. 16 (5) Watercraft trailer dealer.--Any person regularly 17 engaged in the business of selling watercraft and trailers 18 used exclusively for the transport of the watercraft. 19 (6) Automotive detailing and cosmetic grooming.--Any 20 person regularly engaged in the business of automotive 21 detailing and cosmetic grooming. 22 Section 2.
