        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           JUNE 30, 2006

                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for Gold Star Family registration plate.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Title 75 of the Pennsylvania Consolidated
     6  Statutes is amended by adding a section to read:
     7  § 1365.  Gold Star Family plate.
     8     (a)  General rule.--Upon application of a family member of a
     9  person who was killed while serving on active duty in the
    10  military, ACCOMPANIED BY A FEE OF $20 WHICH SHALL BE IN ADDITION  <--
    11  TO THE ANNUAL REGISTRATION FEE, AND BY SUCH DOCUMENTATION AS THE
    12  DEPARTMENT SHALL REQUIRE, the department shall issue to the


     1  family member a special registration plate DESIGNATING THE        <--
     2  VEHICLE SO LICENSED AS BELONGING TO A FAMILY MEMBER OF A PERSON
     3  WHO WAS KILLED WHILE SERVING ON ACTIVE DUTY IN THE MILITARY. THE
     4  DEPARTMENT SHALL DESIGN AND PRODUCE THE SPECIAL REGISTRATION
     5  PLATE carrying the Service Flag Gold Star rimmed with blue which
     6  represents sacrifice to the cause of liberty and freedom. The     <--
     7  plate shall have a five-point gold star on the left side with a
     8  single point facing upward. In addition, the star shall be
     9  outlined in blue with a gray shadow in the center. The words
    10  "Gold Star Family" shall be clearly displayed along the bottom
    11  of the plate. and the letters "GSF" shall be stacked on the left  <--
    12  side of the plate next to the star symbol. The department may
    13  charge a $20 fee in addition to the annual registration fee. The
    14  special registration plate may be used only on a passenger car
    15  or truck with a registered gross weight of not more than 10,000
    16  pounds.
    17     (b)  Documentation required.--For the purposes of this         <--
    18  section, applicants may submit to the department a sworn
    19  affidavit stating that any required documentation testifying to
    20  the death of the military person is unattainable or no longer in
    21  existence. The affidavit must be notarized, and applicants
    22  falsifying the information are subject to the penalties for
    23  perjury.
    24     (c)  Personalization.--The department shall, upon application
    25  for the special plate as prescribed in subsection (a) and upon
    26  payment of an additional $20 fee, issue a personal special
    27  registration plate to applicants authorized in this section. AN   <--
    28  APPLICANT FOR A GOLD STAR FAMILY PLATE SHALL CERTIFY ON A FORM
    29  APPROVED BY THE DEPARTMENT THAT THE APPLICANT IS A FAMILY MEMBER
    30  OF A PERSON WHO WAS KILLED WHILE SERVING ON ACTIVE DUTY IN THE

     1  MILITARY.
     2     (d) (C)  Definition.--As used in this section, the term        <--
     3  "family member" includes the following:
     4         (1)  Widow.
     5         (2)  Widower.
     6         (3)  Mother.
     7         (4)  Father.
     8         (5)  Stepmother.
     9         (6)  Stepfather.
    10         (7)  Mother through adoption.
    11         (8)  Father through adoption.
    12         (9)  Foster mother in loco parentis.
    13         (10)  Foster father in loco parentis.
    14         (11)  Son.
    15         (12)  Daughter.
    16         (13)  Stepson.
    17         (14)  Stepdaughter.
    18         (15)  Son by adoption.
    19         (16)  Daughter by adoption.
    20         (17)  Brother.
    21         (18)  Sister.
    22         (19)  Half brother.
    23         (20)  Half sister.
    24     Section 2.  This act shall take effect in 60 days.
