AN ACT
1 Amending the act of January 25, 1966 (P.L.1546), entitled "An
2 act providing scholarships and providing funds to secure
3 Federal funds for qualified students of the Commonwealth of
4 Pennsylvania who need financial assistance to attend
5 postsecondary institutions of higher learning, making an
6 appropriation, and providing for the administration of this
7 act," reducing certain age requirements and changing certain
8 eligibility provisions.
9 The General Assembly of the Commonwealth of Pennsylvania
10 hereby enacts as follows:
11 Section 1. Clause (2) of subsection (a) of section 4, act of
12 January 25, 1966 (P.L.1546), entitled "An act providing
13 scholarships and providing funds to secure Federal funds for
14 qualified students of the Commonwealth of Pennsylvania who need
15 financial assistance to attend postsecondary institutions of
16 higher learning, making an appropriation, and providing for the
17 administration of this act," is amended to read:
18 Section 4. (a) Any student is eligible for consideration for
19 a State scholarship providing:

21 (2) He meets the [residency] domicile requirements as
1 follows: 2 (i) A student who is under [twenty-one] eighteen years of age 3 at the time he makes application for an award or to renew an 4 award must have a supporting parent or guardian who has been a 5 bona fide [resident] domiciliary of the Commonwealth of 6 Pennsylvania for at least twelve months immediately preceding 7 the date of application or renewal. 8 (ii) A student who is [twenty-one] eighteen years of age or 9 over must have been a bona fide [resident] domiciliary of the 10 Commonwealth of Pennsylvania for a period of at least twelve 11 months prior to the time he makes application for an award or to 12 renew an award. 13 (iii) Any period of time during which a person is enrolled 14 as a student in [a postsecondary] AN educational institution may <-- 15 not be counted as a part of the twelve months' [residence] 16 domicile herein required when [it appears that] the student came <-- 17 into the Commonwealth [and] OR remained in the Commonwealth for <-- 18 the [primary] purpose of attending a school or college. This <-- 19 shall be determined by the agency. 20 (iv) For purposes of determining [residency] domicile under 21 this act a guardian shall be any person or persons other than a 22 parent with whom a minor child has lived and been in the 23 continuous direct care and control for a period of not less than 24 two years. 25 (v) The agency shall make the final decision in all matters 26 pertaining to [residency] domicile. 27 (vi) In view of the fact that Pennsylvania domiciliaries 28 attending approved institutions of higher learning located 29 outside of Pennsylvania may exercise their right of franchise by 30 absentee ballot, a student who registers to vote in a state 19710H1691B2990 - 2 -
1 other than the Commonwealth of Pennsylvania shall be deemed to 2 have abandoned his domicile in Pennsylvania and shall be 3 ineligible for consideration for a State scholarship or renewal 4 thereof or any further payments thereon unless and until such 5 student registers to vote in the Commonwealth of Pennsylvania. 6 * * * 7 Section 2.
