        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           JANUARY 31, 1972

                                     AN ACT

     1  Amending the act of March 25, 1785 (2 Sm. L. 299), entitled "An
     2     act for the limitation of actions to be brought for the
     3     inheritance or possession of real property, or upon penal
     4     acts of Assembly," reducing certain age requirements.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section IV., act of March 25, 1785 (2 Sm. L.
     8  299), entitled "An act for the limitation of actions to be
     9  brought for the inheritance or possession of real property, or
    10  upon penal acts of Assembly," is amended to read:
    11     Sect. IV.  Provided also, and be it further enacted by the
    12  authority aforesaid, That if any person or persons having such
    13  right or title be, or shall be at the time such right or title
    14  first descended or accrued, within the age of [twenty-one]
    15  eighteen years feme-covert, non compos mentis, imprisoned, then
    16  such person or persons, and the heir or heirs of such person or
    17  persons, shall and may, notwithstanding the said twenty-one
    18  years be expired, bring his or their action, or make his or
    19  their entry, as he, she or they might have done, before the

     1  passing of this act, so as such person or persons, or the heir
     2  or heirs of such person or persons, shall, within ten years next
     3  after attaining full age of eighteen, discoverture, soundness of
     4  mind, enlargement out of prison, or coming into the said United
     5  States, take benefit of or sue for the same, and no time after
     6  the said ten years; and in case such person or persons shall die
     7  within the said term of ten years, under any of the disabilities
     8  aforesaid, the heir or heirs of such person or persons shall
     9  have the same benefit, that such person or persons could or
    10  might have had, by living until the disabilities should have
    11  ceased or been removed; and if any abatement happen in any
    12  proceeding or proceedings upon such right or title, such
    13  proceeding or proceedings may be renewed and continued, within
    14  three years from the time of such abatement, but not afterward.
    15     EXCEPT ANY INDIVIDUAL WHO, AT THE TIME THIS ACT BECOMES        <--
    16  EFFECTIVE, IS BETWEEN THE AGES OF EIGHTEEN AND TWENTY-ONE YEARS
    17  AND IS UNDER A DISABILITY DESCRIBED ABOVE, SHALL BE AT LIBERTY
    18  TO BRING THE SAME ACTIONS, WITHIN THE TIME HEREBY BEFORE
    19  LIMITED, AFTER OBTAINING THE AGE OF TWENTY-ONE YEARS.
