                                     AN ACT

     1  Amending the act of June 27, 1939 (P.L.1207), entitled, as
     2     amended, "An act regulating the appointment, promotion,
     3     suspension, reduction, removal, and reinstatement of employes
     4     (except chiefs, and chief clerks) in bureaus of fire and fire
     5     alarm operators and fire box inspectors in bureaus of
     6     electricity, in cities of the second class; defining the
     7     powers and duties of Civil Service Commissions for such
     8     purpose in said cities; and repealing inconsistent
     9     legislation," reducing certain age requirements.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     Section 1.  Section 3, act of June 27, 1939 (P.L.1207),
    13  entitled, as amended, "An act regulating the appointment,
    14  promotion, suspension, reduction, removal, and reinstatement of
    15  employes (except chiefs and chief clerks) in bureaus of fire and
    16  fire alarm operators and fire box inspectors in bureaus of
    17  electricity, in cities of the second class; defining the powers
    18  and duties of Civil Service Commissions for such purpose in said
    19  cities; and repealing inconsistent legislation," amended
    20  November 10, 1965 (P.L.832), is amended to read:
    21     Section 3.  Each applicant for original appointment to a
    22  position in the competitive class in any bureau of fire in any

     1  city of the second class, or to the position of fire alarm
     2  operator or fire alarm box inspector in any such city, shall
     3  undergo a physical examination which shall be conducted by a
     4  commission composed of doctors of medicine appointed for that
     5  purpose by the mayor. Said commission shall certify to the Civil
     6  Service Commission that the applicant is free from bodily or
     7  mental defects, deformities or diseases that might incapacitate
     8  him from the performance of the duties of the position he is
     9  seeking. No application for such appointment shall be received
    10  from any person who is under [twenty-one] eighteen years of age
    11  or over thirty-five years of age at the date of his application,
    12  except that an applicant for the position of fire alarm operator
    13  or fire alarm box inspector in any such city, may be over
    14  thirty-five years of age at the date of his application. Nor
    15  shall any such application be received from any person who shall
    16  not have been a bona fide resident of the city for one year next
    17  preceding the date of his application: Provided, however, That
    18  any applicant for reinstatement as a member of the bureau of
    19  fire or as a fire alarm operator or as a fire alarm box
    20  inspector of any such city in which he makes such application,
    21  who shall have served previously as an employe in such bureau
    22  for a period of more than six months and who, at the time of his
    23  application for reinstatement shall be a resident of such city,
    24  shall be eligible for such reinstatement even though such
    25  applicant shall be over the age of thirty-five years.
