                                     AN ACT

     1  Amending Title 34 (Game) of the Pennsylvania Consolidated
     2     Statutes, further providing for unlawful devices and methods.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Section 2308(b) of Title 34 of the Pennsylvania
     6  Consolidated Statutes, amended July 3, 2007 (P.L.79, No.26), is
     7  amended to read:
     8  § 2308.  Unlawful devices and methods.
     9     * * *
    10     (b)  Exceptions.--The provisions of subsection (a) shall not
    11  apply to:
    12         (1)  (i)  Any archery sight or firearm's scope which
    13         contains and uses any mechanical, photoelectric,
    14         ultraviolet or solar-powered device to solely illuminate
    15         the sight or crosshairs within the scope.
    16             (ii)  Except as otherwise provided under subparagraph
    17         (iii), no archery sight or firearm's scope shall contain


     1         or use any device, no matter how powered, to project or
     2         transmit any light beam, infrared beam, ultraviolet light
     3         beam, radio beam, thermal beam, ultrasonic beam, particle
     4         beam or other beam outside the sight or scope onto the
     5         target.
     6             (iii)  (A)  A flashlight or spotlight may be mounted
     7             on a firearm to take furbearers if the sole source of
     8             power for the flashlight or spotlight is contained
     9             within the flashlight or spotlight or on the person.
    10                 (B)  For the purposes of this subparagraph, a
    11             flashlight or spotlight mounted on a firearm shall
    12             not include a device that projects a beam of laser
    13             light to indicate the intended point of impact for
    14             one or more projectiles discharged from the firearm.
    15         (2)  (i)  Any political subdivision, its employees or
    16         agents, which has a valid deer control permit issued
    17         under section 2902(c) (relating to general categories of
    18         permits).
    19             (ii)  Any licensed hunter in cities of the first
    20         class, while hunting on private property and using a bow
    21         and arrow or crossbow, using bait to attract deer for
    22         removal as provided by commission regulations.
    23             (iii)  Any licensed hunter in special regulation
    24         areas, other than counties of the second class, using
    25         bait to attract deer for removal as provided by
    26         commission regulations.
    27         (3)  Any artificial or manufactured turkey blind
    28     consisting of all manmade materials of sufficient density to
    29     block the detection of movement within the blind from an
    30     observer located outside of the blind.

     1         (4)  Any natural or manmade nonliving bait used to
     2     attract coyotes for hunting or trapping.
     3         (5)  Any electronic or mechanical device used to attract
     4     coyotes for hunting or trapping.
     5         (6)  Any decoy used in the trapping or hunting of
     6     furbearers.
     7         (7)  Any semiautomatic rimfire rifle, .22 caliber or
     8     less, for the taking of coyotes, foxes or woodchucks.

    10     Section 2.  This act shall take effect in 60 days.
