§ 1524.  Referendum on additional licensed facilities.

8

(a)  Procedure.--Prior to the addition of licensed facilities

9

in this Commonwealth, an election shall be held on the date of

10

the general or primary election immediately preceding any

11

general election to determine the will of the electors with

12

respect to the addition of licensed facilities within the limits

13

of this Commonwealth under the provisions of this part. Where an

14

election shall have been held at the primary election in any

15

year, another election may not be held under the provisions of

16

this part sooner than four years after the prior election.

17

Whenever electors equal to 25% of the highest vote cast for any

18

office in any Statewide office at the last preceding general

19

election shall file a petition with the Secretary of the

20

Commonwealth to place such a question on the ballot, the

21

Department of State shall cause the following question to be

22

placed on the ballot or on the voting machine board:

23

Do you favor the addition of licensed facilities in the

24

Commonwealth?

25

(b)  Vote.--No addition of licensed facilities shall be

26

granted unless the majority of the electors voting on the

27

question vote "yes," but if a majority of the electors voting on

28

the question vote "no," there shall be no addition of licensed

29

facilities in this Commonwealth, unless and until, at an

30

election at least four years later, a majority of the voting

31

electors vote "yes" on the question.

32

(c)  Voting proceedings.--Proceedings under this section

33

shall be in accordance with the act of June 3, 1937 (P.L.1333,

34

No.320), known as the Pennsylvania Election Code.
