AN ACT
Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
Statutes, in inspection of vehicles, further providing for
prohibition on expenditures for emission inspection program.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 4706 of Title 75 of the Pennsylvania
Consolidated Statutes is amended by adding a subsection to read:
§ 4706. Prohibition on expenditures for emission inspection
program.

(g.1) Enhanced emission inspection program amendment.--
(1) The Department of Environmental Protection, in
cooperation with the department, shall develop and submit for
approval to the Environmental Protection Agency an amendment
to the existing enhanced emission inspection program. The
amendment shall provide that a subject vehicle with a model
year of 1992 through 1995 that is registered in a county
under 67 Pa. Code § 177.51(f)(2) or (4) (relating to program
requirements), and a subject vehicle with a model year of

1996 or newer with a gross vehicle weight rating between
8,501 and 9,000 pounds that is registered in a county under
67 Pa. Code § 177.51(f)(5) 177.51(f)(2) or (4) , shall be
required to undergo the following tests:
(i) A fuel filler gas cap test, as specified in 67
Pa. Code § 177.204(3) (relating to basis for failure),
that determines if the vehicle's gas cap is functioning
as designed.
(ii) A visual emission control device inspection,
administered as specified in 67 Pa. Code § 177.204, of
the vehicle emission control system.
(2) Upon approval by the Environmental Protection Agency
of the amendment to the enhanced emission inspection program,
the secretary shall transmit notice of the approval to the
Legislative Reference Bureau for publication in the
Pennsylvania Bulletin. The emissions testing required by the
amendment shall apply 120 days following publication of the
notice.
