Senate of Pennsylvania
Session of 2017 - 2018 Regular Session

MEMORANDUM

Posted: May 22, 2017 01:19 PM
From: Senator Kim L. Ward
To: All Senate members
Subject: 2nd Class County Sheriff Warrant Fees

I am introducing legislation amending the Sheriff Fee Act to allow sheriffs in 3rd class counties to establish, increase, decrease, modify or eliminate fees and charges used exclusively to offset existing costs, with the approval of the president judge of the county’s court of common pleas.

The act currently only permits sheriffs in 2nd class counties to do this. All other counties must itemize costs which means sheriff deputies have to calculate exact mileage and costs on each and every case in which a warrant is served. This is burdensome for the county compared to an all-inclusive fee which also enables an individual arrested to pay a flat-fee, rather than paying one bill for the payment of costs and a second bill for an itemized warrant service fee.

If you have questions regarding this legislation, please feel free to contact me or Geri Sarfert, my legislative director, at (717) 787-1640.
