MEMORANDUM

Posted: December 1, 2016 01:27 PM
From: Senator Kim L. Ward
To: All Senate members
Subject: Failure to Disclose Employment Information to Law Enforcement

I am re-introducing legislation amending the Crimes Code to make it a third-degree misdemeanor to provide law enforcement false or incomplete information regarding employment.

The Allegheny County District Attorney’s office began an investigation last June of a man whom they suspected of soliciting a minor online for sex. He admitted to the exchange and upon a search of his home computer, several images deemed as child pornography were found.

It was not until the man was charged and arrested last month that the District Attorney’s office and school officials discovered he was a middle school teacher because he never disclose that information to investigators at any time, only telling them he worked at Target. He continued to work as a math teacher for seven months despite being under investigation and admitting almost immediately to "sex-chatting" with the minor, all because he failed to disclose his employment with the school district to authorities.

My bill will amend Title 18, §4914 to include failure to disclose employment information to law enforcement within the offense of false identification to law enforcement authorities. In addition to being subject to up to one year in jail as a third-degree misdemeanor, the legislation also institutes a fine of at least $1,000 for the offense.

This legislation was SB 1203 of last session and co-sponsors were Senators Reschenthaler, Rafferty, Vulakovich, Mensch, Browne, and Stefano.
