Subject: Act 101 of 1988, the Municipal Waste Planning Recycling and Waste Reduction Act
 
In the near future, I plan to introduce legislation that amends Act 101 of 1988, known as the Municipal Waste Planning Recycling and Waste Reduction Act.

Act 101 of 1988 established Pennsylvania's recycling laws and supplies partial funding for County Solid Waste Plans; recycling programs, projects, equipment, and education; County Recycling Coordinators; and incentives to municipalities based on the tons of material recycled.

The Act established a $2-per-ton fee on all waste disposed at municipal waste landfills and waste-to-energy facilities, established grants for local collection programs, public education, materials processing and composting facilities, equipment and technical training. This fee is set to sunset in the near future. As a result of the sunset provision, recycling program agreements that are up for renewal with the Commonwealth are not being renewed.

Today, more than 11.6 million residents, at least 94 percent of the state's population, have access to recycling. About 79 percent have convenient access to recycling through about 1,050 curb-side pickup programs.

This legislation will go a long way to help us preserve important recycling programs throughout Pennsylvania.
