Subject: Legislation – Unsolicited Text Messaging Act
 
In the near future, I plan on introducing legislation that would prohibit commercial mobile service providers from sending unsolicited text messages without the consent of the subscribers.

Unsolicited advertisements have been sent to non-consenting subscribers in text messages, costing subscribers charges and/or allocation usage deductions.

Under the proposed legislation, commercial mobile service providers would not be permitted to send unsolicited text messages to subscribers without consent. Subscribers who offer their consent will have the ability to revoke their consent at any time. Commercial mobile service providers are not permitted to sell, or offer to sell, such text message services without offering the subscriber the ability to block all incoming and outgoing text messages. Commercial mobile service providers are permitted to send unsolicited text messages if there is no telecommunications charge or allocation usage deduction as a result of sending the text message.

The penalty for violations against this legislation will be up to $5,000 per violation after the first offense, in addition to any penalties provided under the Unfair Trade Practices and Consumer Protection Law. The enforcement of the law will be under the jurisdiction of the Attorney General.
