Subject: | Motor Vehicle Event Data Recorder Act |
In the near future I intend to re-introduce legislation that would be cited as the Motor Vehicle Event Data Recorder Act. This legislation pertains to the Event Data Recorder (EDR) (also, referred to as the black box for vehicles) present in vehicles. My legislation would make it clear that a new vehicle purchaser be notified at the time of purchase that the vehicle has an EDR; access to EDR information should be granted with the express permission of the vehicle owner, or lacking that, a court order where legitimate need for the data has been demonstrated; and that the EDR data belongs to the vehicle owner and cannot be accessed except under certain circumstances. These circumstances would be court order, provide emergency medical services, vehicle repair, traffic safety research purposes where the data cannot be traced to a specific vehicle or with the owner's consent. On December 6, 2012, the Office of Management and Budget gave clearance to the National Highway Traffic Safety Administration (NHTSA) to proceed with a proposal to mandate the installation of event data recorders in all light vehicles. As of September 1, 2014, all new cars, light trucks, vans and SUVs sold in the United States must be equipped with an Event Data Recorder In light of this decision it is important to ensure that motorist privacy is protected. Currently, 15 states (up from 13 when I introduced this bill in 2013) have laws related to accessing EDR data. This bill was introduced last session as SB 678 and was co-sponsored by Senators GORDNER , BREWSTER, FONTANA , VULAKOVICH , VOGEL, BAKER , COSTA , BROWNE , TARTAGLIONE and BOSCOLA.
