Subject: | Requirements for Circulators of Petitions for the Office of School Director |
I plan to introduce legislation which will remove the requirement that the circulator of a nomination petition for a school board candidate be a member of the political party designated on the nomination petition. Current law allows school board candidates to cross-file in the primary election, having their names placed on the ballot of both political parties. However, the law also requires the circulator of a nomination petition to sign an affidavit setting forth that he or she is a qualified elector duly registered and enrolled as a member of the designated party. In contrast, circulators for other candidates permitted to cross-file – i.e., candidates for the Court of Common Pleas, Philadelphia Municipal Court, and Magisterial District Judge – are exempt from this requirement. This legislation will eliminate the inconsistency. It will also make the technical change from “justice of the peace” to “magisterial district judge.” This legislation will be similar to Senate Bill 255 (printer’s number 153) from the 2013-14 legislative session. |
