Subject: ATV Definition Update
 
In the near future, I will introduce legislation amending Title 75 to update the ATV definition, which will allow for titling and registration of innovative new vehicles.

A 2012 study by the Western Governors Association identified that Commonwealth consumers spend $8 billion annually on outdoor motorized recreation, including $3.6 billion specifically for off-road motorcycle, ATV, and recreational off-highway vehicle use. This growing part of our economy comes from new and used vehicle purchases, accessories, services, and tourism-related spending.

Additionally, according to the same study, the outdoor recreation industry in Pennsylvania:
  • Provides $21.5 billion in wage and salary income;
  • Generates $1.6 billion in state and local tax revenue; and
  • Directly supports 219,000 jobs.
The bill allows for an increase in weight for class 1 ATV and the use of innovative airless tires, which comes standard on some newly released vehicles. Under the current statutory definition of ATVs, some newer vehicles cannot be titled, registered, or used in Pennsylvania. The new tire design was developed for use by United States and allied forces throughout the world. The non-pneumatic, never-flat tire technology increases vehicle handling in rugged terrain and is composed of a central polymeric web, surround by a rubber tread band, which allows continuous operation, even if up to 30 percent of the web is damaged.

Updating the definition to align with consumer demand and new innovative technology will increase the number of titled and registered vehicles within the Commonwealth, thus increasing revenue to the Snowmobile/ATV fund. Funds from titling and registration are distributed to the Snowmobile/ATV fund, which provides funding for safety training, enforcement, trail construction, maintenance and other related uses.

We must support the Title 75 ATV definition updates to continue fostering the innovative growth in this sector of Pennsylvania’s economy and ensure that our constituents have access to newly released products that meet their needs. We must also protect our dealers, vital to our local economies, so they can compete with dealers in surrounding states.

I ask you to join me in this effort and cosponsor this important piece of legislation. The changes will greatly benefit outdoor enthusiasts and enhance Pennsylvania’s tourism industry.
