Subject: Enhanced Sentencing for DUI/DWI with a child in the vehicle
 
In the near future we plan on introducing a bill to provide sentencing enhancements when there is a violation of Endangering Welfare of Children (Title 18) and a conviction of DUI/DWI (Title 75) in which a child is a passenger.

This bill comes as a result of discussions surrounding the Task Force on Child Protection’s recommendations of updates to the child abuse definitions. Some aspects of original proposal were better suited in a law enforcement setting as opposed to County Children and Youth agencies. This bill would aim to alleviate the concerns raised about the placement of DUI/DWI in Title 23 by providing sentencing enhancements in Title 18.

The sentencing enhancements would only apply if the child suffers serious bodily injury or bodily injury as a result of the violation. If you have any questions please contact our office.
