Session of 2013 - 2014 Regular Session

MEMORANDUM

Posted: May 23, 2013 09:05 AM
From: Senator David G. Argall
To: All Senate members
Subject: Option to Eliminate Prothonotary’s Office in Fourth Class Counties

In the near future, I will be introducing legislation that would amend the County Code to permit a County of the Fourth Class to eliminate the office of Prothonotary, moving its duties to the County Clerk of Courts office.

Pennsylvania and Delaware are the only two states that have the position of the Prothonotary in county courthouses. I believe providing the County Commissioners the opportunity to consolidate these two offices will save money and resources locally, while providing for a more efficient county government.

This initiative was brought to my attention by a local Prothonotary who ran for election with the goal to eliminate his office.

This bill will provide flexibility to Counties of the Fourth Class by giving the County Commissioners the option to adopt a resolution to provide that the Clerk of Courts office absorbs the duties of the Prothonotary’s office.

Please contact Jon Hopcraft of my office at 787-2637 or at jhopcraft@pasen.gov with any questions.
