Subject: Memo #20 – Alternative for a First Class Township’s Legal Advertising
 
In the near future, I will offer an amendment to the First Class Township Code that will provide another option for the municipality to meet the public notice requirement for legal advertising. Specifically, this proposal will amend Section 110 (Legal Advertising) to allow the township to meet the legal requirement by publishing the notice in any newspaper circulating generally within the township.

Currently, a township of the first class must publish the notice in a newspaper of general circulation that is “printed in the township, if there is such a newspaper, and, if not, then in a newspaper circulating generally in such township.”

This is a very narrow amendment that offers flexibility and another option to these townships. Furthermore, making the change would be consistent with identical amendments already adopted into both the Second Class Township Code and the Borough Code in recent years. Thus, the First Class Township Code would have the same legal advertising requirements as these other Codes.
