Subject: Nursing Facilities Spending Floor Requirement For MA Resident Care
 
In the near future I will be introducing legislation requiring nursing care facilities to meet the requirement that the resident care cost per diem is 95% or more of their Medicaid (MA) resident care component. Currently, there are no consequences if a nursing care facility does not spend MA resident funds on resident care. Facilities have the discretion to spend the MA funds on non- resident care items.

In my view taxpayer funds provided for MA resident care should be spent on MA resident care and not on items unrelated to direct MA resident care. Once this requirement is put into law, the Commonwealth will be able to easily assess whether a nursing facility meets the 95% spending requirement by comparing data that nursing care facilities currently provide. There will be no new reporting requirements under this legislation. The Commonwealth can evaluate whether or not the facility is meeting the requirement by comparing the quarterly MA resident care per diem rate to the facility’s per diem of resident care allowable costs for all residents reported in the annual cost report.

This legislation will improve MA resident care by insuring that taxpayer funds provided for resident care are spent directly on the MA resident. In addition, if the facility is not meeting the 95% requirement, the Commonwealth will recoup funds from the facilities that do not meet the requirement.
