Subject: Narcotic Treatment Program
 
In the near future, I will re-introduce SB 1277 of 2011-12. This legislation will provide communities with the ability to weigh in on the approval process of Narcotic Treatment Facilities. This legislation will be building off the Pennsylvania Drug and Alcohol Control Abuse Act of 1972. My proposed legislation aims to include the community and tighten loose regulations currently in place for these facilities. The legislation has three key provisions that will ensure community involvement in the placement of these facilities.

First, this legislation will require law enforcement involvement in the approval process. My legislation would require that the owner of the proposed facility would need to receive approval from the local District Attorney in the area covering the proposed facility. Local law enforcement approval is essential due to their expertise of the local drug problems and impact of these treatment facilities.

Secondly, adequate parking must be available before the facility can be approved by the Department of Health. These facilities can serve as many as 350 people daily. The availability of parking can be a major concern for the community.

Finally, the Department of Health shall provide written notice to all locally elected public officials at the city, state, and federal levels of the proposed location of this facility immediately upon receipt of the application. Notice will also be given to Single County Authorities, the county agency responsible for providing drug and alcohol addiction treatment to Pennsylvanians who have government sponsored health insurance. The notice shall include the name of the applicant, the names of the applicant’s employees or officers, the facility’s proposed location, and a copy of the location. The applicant shall pay for the notification.
