Subject: | Motor Vehicle Event Data Recorder Act |
I intend to introduce legislation that would be cited as the Motor Vehicle Event Data Recorder Act. This legislation pertains to the Event Data Recorder (EDR) (also, referred to as the black box for vehicles) present in vehicles. My legislation would make it clear that a new vehicle purchaser be notified at the time of purchase that the vehicle has an EDR (not all vehicles do); access to EDR information should be granted with the express permission of the vehicle owner, or lacking that, a court order where legitimate need for the data has been demonstrated; and that the EDR data belongs to the vehicle owner and cannot be accessed except under certain circumstances. These circumstances would be court order, provide emergency medical services, vehicle repair, traffic safety research purposes where the data cannot be traced to a specific vehicle or with the owner's consent. Currently, 13 states have laws related to accessing EDR data. On December 6, 2012, the Office of Management and Budget gave clearance to the National Highway Traffic Safety Administration (NHTSA) to proceed with a proposal to mandate the installation of event data recorders in all light vehicles. In light of this decision it is important to ensure that motorist privacy is protected. |
