I plan to introduce legislation that would create a registry for individuals convicted of multiple drug offenses similar to the sexual offender registry required under Megan’s Law. I believe that the public should have adequate notice and information about these offenders since they pose a high risk of engaging in further drug offenses. Under the Controlled Substance, Drug, Device and Cosmetic Act of 1972, an individual convicted of a second or subsequent offense of the manufacture, delivery or possession with intent to manufacture or deliver a controlled substance (i.e., a 2nd or subsequent violation of clause (30) of subsection (a) of section 13 of the act) is already subject to increased jail time and fines at the court’s discretion. The bill I propose would have any individual convicted of a third or subsequent offense of clause (30) of subsection (a) of section 13 of the act would have to register their name and address with the State Police under a newly established drug offender registry. Offenders would remain on the list for a period of ten years. The new registry would be modeled after Megan’s Law.
