Session of 2013 - 2014 Regular Session

MEMORANDUM

Posted: January 3, 2013 01:28 PM
From: Senator Kim L. Ward
To: All Senate members
Subject: Memo #20: Pro Se Child Abuse

I plan to introduce legislation that amends 18 Pa. C.S. §4304 (relating to endangering welfare of children) by making it a misdemeanor of the first degree for a parent, guardian or other person supervising the welfare of a child under 18 years of age to knowingly or intentionally leave that child alone with an individual subject to sexual offender registration requirements.

A constituent in my district recently contacted my office with concerns that her daughter’s boyfriend, who is a registered sex offender, has regular unsupervised contact with the daughter’s children. While one could argue that the parent has knowingly endangered the welfare of their child by leaving their child in the unsupervised care of a registered sex offender, there is no specific offense that prohibits this action. My legislation would remedy that situation.

If you have any questions, please contact my office at 717-787-6063.

Introduced as SB518
