MEMORANDUM

Posted: December 21, 2012 12:00 PM
From: Senator John C. Rafferty, Jr.
To: All Senate members
Subject: Elimination of Statute of Limitations for Certain Sexual Offenses

In the near future, I will be re-introducing legislation (SB879) to eliminate the statute of limitations for major sexual offenses for the life of the victim when the offense occurred against a child below the age of fourteen.

Currently, a prosecution for a major sexual offense must be commenced within twelve years after the alleged offense was committed. An exception exists within the section that applies to sexual offenses committed against a minor. The exception states that the statute of limitations for major sexual offenses does not commence until an individual is 18 years of age. With this exception in place, an individual only has until age 30 to prosecute for such an offense.

Introduced as SB560
